Need some DESPERATE HELP

So 2 days ago, my friend Grace and her friend (Lets call her Mo who is a degenerate human being), decide to visit a mutual friend before Grace has work later that afternoon. Mo apparently blazed and drank 2 beers. Grace drove them to the mutual friend and then drove to the restaurant to go to work. Mo needed a ride home, so Grace let her drive her Honda 5 minutes back home as long as she agreed to pick her up when her shift was done.

Mo gets to the apartment gates, turns in front of an oncoming car and wreck's Grace's car. It was her fault, the cop came took the report etc. Grace has liability only, and Mo said she would pay for the damages. Well in reality, Mo is a degenerate fat piece of shit who doesn't work, and lives with her BF. Tonight she said she wasn't "legally required to pay for the damages" even though she wrecked the car intoxicated. Unfortunately the cop didn't know she drank and was high. So I went over there calmly at first to politely ask her to pay for the damages. She basically told me if I had an "attitude" she wouldn't do jack shit. I got pissed and told her I would get a lawyer and chase her to hell if I had to, as well as mention the fact she had been intoxicated during the crash. She started screaming saying she had no money and to sue her.

So WTF can I do to get this degenerate obese piece of human shit to pay up? Or get the money to fix my friends car? The car is undrivable, the front axle needs serious work.

if they were drunk on record, you can sue for damage repairs. but if off record . you cant. nothing you can doo. just be glad the ass hole did not kill any body, im not a professional lawyer by any means . but I have been around seen a lot of stuff, don't waste your money on a lawyer, it could be a down payment. on a new car.

After doing some reading, it seems like people have had some success in California's small claims court with this kind of situation.

Sounds, like that acquaintance is over.
Let your wife deal with it.
If nothing comes from it.... Judge Judy or let it go.

Hopefully a lesson learned by your wife and there will not be a repeat.

Peace in the Household is better than Drama.

hope you can get some justice in small claims, may be trying to get blood out of a stone though
if you loan somebody $100 and never see them again, it was probably worth it
not that this was a loan, but still a bargain to get rid of them
 
So your friend Grace knew this person had been drinking and smoking and still let her drive the car? I'm sorry but this looks to be a hard learned lesson. Even if you bring up the fact that big Mo was intoxicated, how would that look for Grace in court....that she let an intoxicated person drive her car? Best of luck recovering any damages.

Since the cop did not cite her for DUI, then I would say that there is zero evidence for intoxication. Best not even to mention it. Maybe you can get something out of your small claims system for the damages, but I wouldn't waste much money on a lawyer. IMHO, lawyers are parasites that would be perfectly happy to take your money even if they know that you aren't going to prevail in court.

Just be glad nobody was seriously injured or your daughter would be liable. You can sue her and win a judgement, but good luck on collecting it. Life lesson learned, never loan your car to anyone.

Cut your losses and move on. Unless you have something in writing by her, or on video, it'll be your word against hers. If you had something that was physical, then it would show her intent. There are legal issues and moral issues...courts only deal with legal ones, unfortunately; yours is a moral issue.

She let a person she knew was under the influence drive her car. You're lucky you're not being sued.

In a nutshell, nothing. You can sue her and get a judgement, but if she has no money and no income, you still can't collect. Your friend was foolish for letting a drunk drive her car. Just think of it as a "stupid tax".
