I believe your right actually. It has been prepared** the intended filing date is July 1st from what I am hearing on facebook. I will update when I confirm this, as they are asking Arizona residents to show up to the court to show their support for this complaint.

There's something else about "patients must have 24/7 access to med's" I thought to use.

I can't find it maybe you know and can outline its location in the rule books?

I have joined Mr.Floyd in fighting the 25 Mile Rule. We are in the same situation! We were denied for requesting to grow.

In the coming week we will be filing a Declaratory Judgement and an Injunction against the 25 Mile Rule.

Support is needing in the coming weeks! Hope to make this stick!

I found this the other week reading laws. If interpreted right; might help our case.

Arizona Laws > Title 44 > Chapter 10 > Article 1 > § 44-1403 - Establishment, maintenance or use of monopoly


The establishment, maintenance or use of a monopoly or an attempt to establish a monopoly of trade or commerce, any part of which is within this state, by any person for the purpose of excluding competition or controlling, fixing or maintaining prices is unlawful.


I believe its arguable to say flowers would be 1.50 per gram if everyone grew their own. lol
 
I wish I could agree with you but since there are multiple dispensaries competing against each other, that by definition is not a monopoly. If all the dispensaries were owned by 1 company, it would be a monopoly.

A monopoly (from Greek monos μόνος (alone or single) + polein πωλεῖν (to sell)) exists when a specific person or enterprise is the only supplier of a particular commodity

Maybe they are all owned by 1-2 parent companies like our thousands of printed informational s a day. :wall:

It needs to be separate in the law about people / business monopoly. They shouldn't be able to lock us out like they cant do to each other.

It much more closely resembles an oligopoly, except that it would be very difficult to prove that these separate entities (dispensaries) are working together to set the price on their indistinguishable good (MMJ). Oligopolies are supposed to be avoided but are pretty common practice in the states these days. Look at the communications companies these days.. 99 % of America is on one of 4 cell providers all basically providing the same exact service... you are limited to specific Internet providers in your area that price fix (etc)

I don't think there is a specific Arizona state law regarding oligopolies at the state level.

They do get to grow yet if dispensaries don't grow the strain they need.
It might be worth pursuing this in court here. I know my meds aren't grown in a dispensary.

Interesting angle. The strain I need (harlequin) is high in CBD's and the dispensary doesn't have it. Other strains help my spasms but only Harlequin and Omrita stop them.

Looks like we will be pushing the filing date to Tuesday.

Reason - Any lawsuit regarding the constitutionality of a statute must be also filed with the Speaker of the House, Senate President and I believe the Attorney General must receive a notice and all info in regards to the claim. As you all know Mr. Floyd and I recently joined forces and we are certain the '25
Mile Rule' will cease to burden patients and their caregivers once we file this lawsuit!

Why didn't they e-mail this.. If i don't know i don't go ! I have asked them a couple a times what they were going to about 25 mi rule and all they ever said to me was "i don't know". Pretty weird when they run there business based on our business. But still happy there at least thinking about it now.

Hopefully they were smart enough to support Legalization and ditch the 25 mile rule.

The dispensary lobbyist said himself... "The legalization measure likely will NOT make it on the 2014 ballot. Much better luck for 2016 election season."

We have about a year left to collect signatures. That lobbyist is doing his job, lying.
