Can I sue the local Pot Dealer for running off with my Money?

I would say yes you can. You had a verbal contract and he failed to deliver and that would be the basis of your lawsuit. You may find yourself having other issues with police on the basis of the nature of your contract (weed :) )but that is a SEPERATE criminal issue that has no bearing on your civil claim of your deadbeat friend being in breach of contract. Step 1, you need to get an attorney.
Did you even read the post I gave above, or did you just read the topic, skip to the end, and post your own interpretation?

Not only that, but depending on the state and governing statutory regulations, more than likely the Statute of Frauds bars you from recovery on this topic. Generally speaking, the Statute of Frauds says that anything that you buy for over $500 needs to have a WRITTEN contract. Oral contracts for the sale of goods over $500 does not create binding contracts.

Sorry to hear you got jacked. If this guy was really a friend he would not have taken your money. So however much he took it was probably worth it to have him out of your life.

You really should read the text of the Michigan MMJ law posted here, http://medcannabis.googlepages.com/textinsmallerprint . If you were buying a pound you were way outside of what this law would protect you with. I'm not sure this law would protect you in buying from anyone other than your designated caregiver.

Thank You for posting the link for the THC Foundation for me. I was there, allthough you wont see me on the news, channels 2, 4 and 7 were there interviewing, because I did everything I could to avoid the camera's. I met alot of wonderful people, some of them have been growing for years for their medical conditions. I recieved tons of growing advice. I even had a couple of pro's offer to help me get set up! Some drove for hours to get there (they came from as far as the U.P.). I actually thought the line to get in would stretch around the block, but it wasnt that bad.

I made the decision to just let it go and erase him from my mind. I no longer want to be stressed when I think of it/him. I fugure, I will be able to save thousands a year by growing my own. And hopefully grow much better quality than I could buy on the street. My way of life will improve dramatically. I need to get rid of all the negativity now before I start growing, I dont want my plants to pick up on it and Hermi on me. Hehehe

i saw that episode of Judge Judy. dude put in for all the equipment, then the dude that was growing tried to screw him at harvest time. Judge Judy ruled in favor of the dude who put in all his money on set-up costs. the grower lost. good episode.

Also if anyone who grows in a med state gets the shaft on a deal thats wrote down they can write the bad debt off on their taxes, and the other person gets charged it on their income. Not 100% on this, but talk to someone who knows taxes more.

On The People's Court, back when Wapner did it in the 80's, they introduced a case where a woman was suing a guy because she gave him $150 for marijuana, but he only came back with $75 worth.. Wapner sat down, and before the courtroom was seated he buntly said "Get the hell out of my courtroom!"..

i understand how ya feel bro, but simple fact of the matter is that its not happening. Even though he did have a verbal contract with said party, the contract is directly related to criminal activity, which concludes criminal intent, which is going to end up throwing your case out on the spot, and probably have a case against the state for the illegal sale, transportation, and distribution of an illicit substance. What you have to remember..

SALE - An agreement by which one of the contracting parties, called the seller, gives a thing and passes the title to it, in exchange for a certain price in current money, to the other party, who is called the buyer or purchaser, who, on his part, agrees to pay such price.

that being said.. what a lot of people fail to realize is that.. even if you've got a joint, and your smoking it with friends, and you pass it around in a circle, that can be labeled as distribution and sale. What if your agreed price is free? just because you don't have any currency being exchanged does not rule out sale.

All in all, the best way to look at it is.. you just payed said amount to get that guy out of your life.. you'll never have to deal with him again.. it was cheaper then sendin out a hit for him, and its getting you the same result.. consider it money well spent and leave the courts out of it.. trust me.. im my game its in my best interest to know whats what in a courtroom.. it will be more trouble than its worth to sue!

as a side note, you never give your money to a dealer until product is in hand.. its the same concept as your buyer.. a seller is going to have product, and can virtually charge any price they want for this product BECAUSE.. if the buyer wants it bad enough, no matter how much they bitch.. if they see that you have what they want, they will pay the price. So.. switch it up on him.. show him your money.. let him get a big whiff of that shit.. and then slip it right back in your pocket till you got product.. if he knows youve got rolls, hes gonna give you product as quickly as possible, thats just the way greed works..

what are you gonna say? "ya i was buying some weed off him and he robbed me for my money." your gonna lose.

Your gonna end up telling the court the friend stole money from you leaving out the weed part any way when you testify and the dealers just gonna be like he was trying to buy weed off me and i just took the money from him cuz hes a friend and i didnt want him to get in trouble. Now you just lost the case and lied under oath lol.

Best thing to do is either go pay your friend a visit and show him why he should never take your money or never talk to him again and let people know he can't be trusted with money so he loses business.

Getting robbed sucks but it happens, that's why you don't put yourself in that situation. If you can't see the weed first why should they get to see your money?

When I was searching the net, I came across a thread about Judge Judy ruling in the favor of the defendant for grow room supplies... or something like that.

But seriously, when I get a MM card, which to my understanding, I will be allowed to grow, buy, transport... etc for my personal medical cond's.
Not in Michigan. It is still illegal to buy it, your caregiver, once all of the administrative rules are in place will be able to recoop his costs and reasonable fees. Possesion of up to 2 1/2 oz, and twelve plants.

Wouldnt I also have the right to go to small claims court, to recoup stolen money?

like I said in the original post, I probably wouldnt... but if technically I could sue, I wouldnt think it would take more than the threat to sue, for him to PAY UP?
Like the man said, you can sue for anything, doesn't mean you will win, and since ithis case you would be admitting to trying to break the law......? VV

The only thing that is effective immediately is that you will be able to present an affirmative defense at trial, until the MDCH isues the cards, and they will take the full amount of time they are allowed, which means April 4th. Hope to see ou at the public meeting about the administration of our new law, all of the infromation is available at the Michigan Department of Community Health website. We have several probems with the proposed rules and we need everyone to show up and let them know this will be done our way. VV

If you were trying to buy the weed before you had the med card in hand the cops will see it as an attempt to purchase a controlled substance and take you to jail.

It's kind of the same thing as getting caught without car insurance and then running out and buying some expecting to get out of the fine.

Where I come from ( NYC) If someone robs you (and you know them) and you just let it go it makes you a punk... If you call the cops and squeal then your a snitch and still a punk.. If it was a large sum of money You should Crack his skull with a ball bat .. If its a small amount of money then just take out a knee.. You gotta teach people like that a lesson..

i'm with korvette on this one recently had issues of a similar kind on a larger scale and there is only one way to deal with it. and going to authorities wether it be civil court or police is grassing and that would make you more of a bitch than the guy who robbed you. just mask up give him a hiding burn everything you was wearing and make sure you got a solid alibi.

tbh m8 i doubt this guy will be physically able to rip anyone off again but the amount was a lot larger, in this case i think a standard good kicking would do the job. watch him till he picks up a nice size bag and take that off him after putting your shoe print on his forehead.
