Can I sue the local Pot Dealer for running off with my Money?

As someone who is waiting to get a MM card in MI, I was wondering if I could take (hopefully only threaten) an X-friend, who took money up front, and never delivered?

I apoligize if this has allready been covered, but I have been searching the net for days trying to find out!

Not sure I would actually do it, cause he isnt a registered dealer. But if he knew I could, I'm sure he would cough up my cash?

BTW, 1st time post..... not sure I did it right..... but I have to start somewhere!

Threaten him with it and watch him laugh in your face for trying to sue him. If he ran off with your money, slash his tires and be done with it. How much $? Whatever that amount of money, try to do 100 times the damage. Slash the tires, and give his car(s) a good dose of paint thinner (ALL OVER).

Yeah that's real smart... Won't be as funny as when the dealer comes back and puts him in the hospital or worse...

If your friends are shady, and you give them money - be willing to accept the loss. Just don't do business with him again.

You can sue for anything in this country, winning is a different case. What you should do is drop him, and advice any other buyer's you know to drop him as well.

When I was searching the net, I came across a thread about Judge Judy ruling in the favor of the defendant for grow room supplies... or something like that.

But seriously, when I get a MM card, which to my understanding, I will be allowed to grow, buy, transport... etc for my personal medical cond's.

Wouldnt I also have the right to go to small claims court, to recoup stolen money?

like I said in the original post, I probably wouldnt... but if technically I could sue, I wouldnt think it would take more than the threat to sue, for him to PAY UP?

i saw that episode of Judge Judy. dude put in for all the equipment, then the dude that was growing tried to screw him at harvest time. Judge Judy ruled in favor of the dude who put in all his money on set-up costs. the grower lost. good episode.

If you're going to threaten him only, I dont think he'll even buy a lawsuit. You were engaged in an illegal activity buying the stuff. If you're just going to threaten him, tell him youll just call the cops on him at random times until he gets fucked. Or just slash and paint thinner.

hahaha chalk it to the game bro unless u are ready to stare the drama the will almost definatly follow if u do pursue this guy. but if he ran off with your money this is the way i look at it and the way i handel things of this nature. a) he is a coward and when you do threatn him he will get his boys and then shit really hits the fan all bs aside.b) he is for real about gettin his a thug and gonna throw down over it with gunplay. its not worth it unless you really feel like he screwed up and needs to learn. but remember that also isnt our decision to make. i would just drop it cuz it sounds like it happend a while back u should have dealt with it then bro not trying to be a prick man

Yeah. The law can't help you, in these types of situations I just take it into my own hands and punish the fucker, usually by costing them far more money than they have cost me. Haven't had to do it in awhile, I have a tighter group of friends, rarely deal with outsiders, and can more often than not detect myself getting fucked before it happens.

Ok - I know in this day and time, litigation seems to solve all that ails you, but in this case, you don't have a legal case. Don't even think about bringing it to the attention of the law. You'll end up on America's Stupidest Criminals or something f*cked up like it. And, as far as retribution, there isn't any and you should leave this in the past!

Consider the freedom that you have now and what you may forsake by "getting even". Your rights aren't covered under any laws on this one, but you are still walking, breathing, and able to buy more weed - or even grow it... my advice for what it's worth... count to ten and each number you count, think of something in your life you've been blessed with: 1 - family, 2 - friends (not this one), 3 - weed (could be # 1), 4 - insert yours here... and so on.

Be thankful for a community of people on RIU that can offer you sound advice. Be thankful that you can lay your head down on your pillow at night without a guilty conscience of taking somebody's money, or doing something possibly more harmful. Every day is a lesson learned. Don't look back - good things ahead bro!

He wouldn't be risking anything by suing. The lawsuit would be brought in small claims civil court. Not criminal court. Civil court could care less what the fuck you do, all they are trying to do is resolve issues between two parties. If you told them you tried to buy pot, they would laugh at you, not arrest you. That's not to say if you confess to something massivly illegal that the bailiff won't place you under arrest, but usually it takes alot to do that.

But to answer your original question, you don't have a legal case. No lawyer will take it, and you would lose if you brought it on yourself. What you would be arguing is breach of contract. Without boring you with the legal specifics, there was an offer, an acceptance, and consideration, which makes a contract legit. You paid up money with the understanding that he would supply you with a product later on. By him not providing the product, he breached the contract, and under normal conditions would be responsible for putting you in the same situation you would be in if he had not breached the contract. Usually this involves giving you the market value of the goods in question. But your 'goods' were actually illegal contraband, and as such any consent to or contract involving illegal items or acts is null and void.

The fact that you are in the process of getting your MM card is irrelevant. If you had your MM card, his acts would still be illegal. I don't know how that would turn out, would be interesting. But if you are working on getting your MM card, that doesn't work retroactively to legalize the illegal acts that you made in the past.

Long story short: You can't sue.

Unfortunately he took me for a pounds worth of $$$. Which really pisses me off! And obviously I will never deal with him again. I have to agree with GrowTech on this one, although it helps me fall asleep at night thinkin of Jacksum's post (since I dont have any Pot).

Well, I saw my Pain Dr today and asked for him to sign the Physician Opinion Form so I could apply for my card. Although he supports the bill, voted for the bill, he said he WOULD NOT sign it, and he feels that any Dr who does sign it, will eventually be shut down by the IRS or DEA. He agreed that it would help me to relax, sleep, and deal with any pain related anxiety, with less side effects than anything he could prescribe for me. Also stated that if I can get a signature from ANY Dr., that he would continue to treat me, and supply me with pain pills, and if I ever get "randomly picked" for urinalysis, he would not throw me out as a patient for THC in my system. But if I dont have a MM card, Out I go!

Next, I'm off to my Family Dr to see if he would sign it, again he had the same opinion. SHIT!

I did find a company that is setting up shop starting tommorrow, and sent them the paperwork for an appt tommorrow. I will post the Website address AFTER I get mine signed (Dont want to help LEO find out about it till I get my signature).

What good is this for MI if the Dr's wont help their own patients who desperately need it?

Sorry to hear you got jacked. If this guy was really a friend he would not have taken your money. So however much he took it was probably worth it to have him out of your life.

You really should read the text of the Michigan MMJ law posted here, http://medcannabis.googlepages.com/textinsmallerprint . If you were buying a pound you were way outside of what this law would protect you with. I'm not sure this law would protect you in buying from anyone other than your designated caregiver.

I would say yes you can. You had a verbal contract and he failed to deliver and that would be the basis of your lawsuit. You may find yourself having other issues with police on the basis of the nature of your contract (weed :) )but that is a SEPERATE criminal issue that has no bearing on your civil claim of your deadbeat friend being in breach of contract. Step 1, you need to get an attorney.
