do you know how hard it would be to track down a gomez or diaz in arizona for a little pay back after hours on the cops and border patrol agents?
he has one hell of a law suit it sounds like.
if he has no witness's he is basicly screwed and will see no justice.
i wonder why people are going to court houses these days and killing cops and judges? a huge mystery isnt it?

First of all when you get your Drivers License you sign off on a thing called "implied consent" on the License form. What that means is you MUST allow a Peace Officer to stop you at a check point and you MUST submit to a blood, breath, or alcohol test if you are suspected of Drunk Driving. Driving is a privilege not a right. It has ALWAYS been that way. Any 16 year old kid in High School Driver’s Education knows this. It’s in the Driver’s Handbook too. :arrow:

Your right to travel has been desided in plenty of court cases. The "laws" about it being a privledge are wrong they arn't laws either they are regulations/codes not law there is a difrence. You can follow the regulations and still be in violation of the law. Believe me I know prison guards who followed regulations and are in prison now for it.

Case # 1 - "Even the legislature has no power to deny to a citizen the right to travel upon the highway and transport his property in the ordinary course of his business or pleasure, though this right may be regulated in accordance with the public interest and convenience. - Chicago Motor Coach v Chicago 169 NE 22
("Regulated" here means traffic safety enforcement, stop lights, signs, etc. NOT a privilege that requires permission i.e.- licensing, mandatory insurance, vehicle registration, etc.)

Case # 2 - "The right of the citizen to travel upon the public highways and to transport his property thereon, either by carriage or by automobile, is not a mere privilege which a city may prohibit or permit at will, but a common right which he has under the right to life, liberty, and the pursuit of happiness."- Thompson v Smith 154 SE 579.

It could not be stated more conclusively that Citizens of the states have a right to travel, without approval or restriction, (license,) and that this right is protected under the U.S. Constitution. Here are other court
decisions that expound the same facts:

Case # 3 - "The right to travel is a part of the liberty of which the citizen cannot be deprived without due process of law under the 5th Amendment." - Kent v Dulles, 357 U.S. 116, 125.

Case # 4 - "Undoubtedly the right of locomotion, the right to remove from one place to another according to inclination, is an attribute of personal Liberty, and the right, ordinarily, of free transit from or through the
territory of any State is a right secured by the l4th Amendment and by other provisions of the Constitution." - Schactman v Dulles, 96 App D.C. 287, 293.

"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

Traveling down the road is not reason enouph for a search and refusing to comply with an unlawful order is not probable cause. Unless you like fascism in which case yeah we all need to show our papers everywhere all the time.

We can argue this back and forth all day but it really comes down to what kind of country we want to live in and the slipery slopes we are on. Did our forfathers want a nation you could not travel freely about in?

Actually, seeings as the border is well the border, it can not be expected that US Law is established at the border.

Besides, it's absurd for the priest to think that he could leave the country and come back with out being searched. That'd be like a Muslim expecting to be able to leave the country and come back with out being searched. Completely absurd.

Who knows what kind of weapons would be brought back if that were the case. Or even worse, Muslims hold a family hostage in return for a family member's cooperation in smuggling weapons, because they won't be searched.

The priest was in the wrong, at least as far as it being the border.

If this had happened with in the US, then the law enforcement would be wrong.

I blame Barack Clinton, or Hillary Obama, either both of those bitches. If they would stop trying to blame the US for the problems at the border and actually attempt to resolve the problems by stationing troops there.

Then there's the fact that there's cities like San Diege and San Francisco that are doing idiotic BS like claiming to be "Sanction" cities, and refusing to enforce US Law regarding immunization and naturalization.

Of course, this entire situation goes back to the idiocy forced upon Reagan by the left when he granted amnesty to the illegals.

What we need is another President like the one that sent Pershing to the border to handle Pancho Villa with an entire Army Brigade or Battalion.



But yeah, totally fucked up situation. I hope he sues the shit out of the Border Patrol.

Though this has the feeling of a deposition.

Yeah, that's the impression I got after watching it a second time. I think he needs to sue the shit out of the Federal Government, and Arizona for Criminal Negligence in that they allowed the Border Patrol to operate inside their territory.

Or whatever State the internal checkpoint was in.

I really didn't think the guy was hard to understand. He was traveling from San Diego to Pheonix and went through a checkpoint, was not crossing the border. He was not suspected of a DUI, it was a random checkpoint in which they said a dog signaled there were either drugs or a person in the trunk. Which there wasn't
If your reaction is anything like Northwestbuds you obviously don't understand the significance of an arrest like this and how they handled it is a sign of what is to come.

I'm not going back to confirm this. It would appear that there were some shady "officers of the law".....Gomez, etc....just acknowledge the names of these "officers." I suspect those officers were abusing their authorities.
I know of at least ONE event that took place in this very same location whereas a Mexcian was attempting to pass into America illegally (imagine that!!!!)....upon his quest to do so, he was TRESPASSING on a man's OWNED land who took it upon himself to subdue their further entrance. That same man was sued and the Mexican alloted HIS LAND!!!!!!!!!! Can you say, "royally f'ed up?

Please note that during the elections, BOTH Democrats and Republican's took their eversovery fleeting "strong" stance on illegal immigrration........pfft. I laughed. I knew then I would never hear of it or their intentional stance again. Wake up America. Left, right, somewhere in the middle, nothing will be accomplished. Before you know it, spanish will be the officla language...go ahead, laugh. Hopefully, I'll stilll be around to say, "I told you so." The question is, "will you?"
