my situation sucks dudes..... it sucks the best actually. and since my buddy turned himself in, i wonder what those cops are doin now since they aren't needed to find the suspect anymore..

Criminal lawyers don't work like that.. There is no money coming your way if you win so they have nothing to gain.. Unless a criminal lawyer sees you case as a worthy cause, or good PR (Which isn't going to happen) you'll have to pay retainer..You might be able to get enough advice to understand what you could expect just by window-shopping for a lawyer over the phone if you ask the right questions.. If you're broke and you do get charged, then you'll have access to a public defender., but obviously not until then..

Probably hunting for another suspected felon.. Doesn't change the fact that you're in the system now..

ok cops said they had a warrant for a homicide investigation.. the person they were lookin for, well, we have the same address. they came in didnnt find him but, they came across my my grow. they took only the plants left everything else.. they also took a triple beam scale, but nothing else. im sure that my stuff wasnt included in the search warrant. but they took it anyway. i had 2000 watts over i think 14 or fifteen plants..about three weeks to go. in another room i had a 1000 watter over about 7 smaller plants. i also had about 45 or so clones rooted already in a tray elsewhere in the house. they took that too. was that legal for them to do that even if it wasnt in the warrant??:finger:
if they had a search warrent for your address even though it was the wrong address you are screwed,

I'm in a medical state and this is exactly why I have an attorney.

Did you receive a copy of the warrant?
They are supposed to give you a lost of ALL items seized, did they?

You are now in the system, be aware of that and take it into account. 16 years ago my house got tossed because of an idiot roommate. I wasn't legal but all they found were lights and empty pots :)

They were more than happy to let me know that my info had been passed along to the local DEA office. We had local PD outside our house all day, every day for a few months. Sucked, had to move and stay under the radar for quite some time.

Be smart man, if your not legal take a break for a while. Jail sucks and prison sucks even more

Forgot to include this. We have my attorneys business card stuck
into the frame of our front door and we each have his card on us at all times. If they ever come to the door we smile and hand them his card. If they have any questions they can ask my attorney. If they have a warrant I call him immediately and he's here within minutes. Seriously man, drop a few bucks and get advice from an attorney.

Do not answer ANY questions at all, they will use anything you say against you. Be polite but don't talk.

They put Kevin Gage (Hollywood actor) in jail for 2 years, and he had a license. wow you're really lucky they didn't charge you.

Handed to the drug detectives and They are watching your house? Seriously you are suspected of being a commercial grower. Why? That's what they do. Suspect people. Observe them. All your friends car plates numbers, etc. If they can build even a specious case, they will put it the DA.

- Officers observed xyz on this date, in Plain Sight
- records of activity in the house after dark
- cars that stop by regularly
- patterns of the suspect activities lead us to believe......

DA thinks hmmm....isn't an indoor pot farm actually a drug lab? That's will play on the evening news.
Call Mary over at the legal desk and set up a presser.

Now that's your worse case. And it is out of your hands. Except if you hire a hot shot lawyer, he may be able to get you the information that this is not a case or even an investigation. But, that's the only way. I spent a lot of treasure to get out of my problems in two states. Still had to be in the slammer for 1 week in one state and 4 weeks in the other.

Justice is expensive and the law dogs (court officers) exchange favors in an informal way. Good luck.

They probly did not have a real warrant, Homicide is a big deal and those guys dont screw around. Had they had a real warrant they would have called patrol officers and had them take you in and charge you. Sucks that you lost the plants but at least you not facing charges for it. Dont be suprised if they dont pass the info on to vice and if they show up and try to give you shit and question you keep quiet. Bottom line if they have a warrant to enter whatever they see is fair game period. You should go retain a lawyer and tell him the story and wish for the best. I personaly think you doddged a giant bullet.

i was already cuffed in a car when they actually did it. these dudes swooped up on me at a business parking lot which is on the other side of alley that i live. i was there ony to have lunch with one of the salon owners. as i pulled into the parking space, just in front of her salon, i had officers,some in uniform, some undercover surrounding my vehicle..
they started to question me about the whereabouts of my buddy. as if i had any clue!? cant give too much info on what their investigation was about but then one of the cops said that they were gonna search the pad. well of course im gonna give them a hard time about giving them any info, even though i didnt know shit, i end up cuffed, in the back of a unit, and we go around the business plaza back to my alley and we came up to my place and i see my door already open. They took my fucken keys out of my ignition! anyway, obviously they seen my grow, lookin for my buddy, during their investigation. i spent a few nights locked up at the station. i was never put under arrest, they questioned me and when they released me, they gave me this stupid paper i had to sign that i was only detained, not arresteded!!!and off i go! Its been almost a week since that day. the person they were lookin for turned himself in with his lawyer yesterday. i wanna know since i had nothing to do with the investigation in the first place, what happens of me. I lost a few days of work, my shit gets ripped off, lots of hard work just shitted on!!! to all fellow growers what do i make of this situation??? thaks for all your inputs!
you got fucked by your fascist gov't. happens all day everyday. sucks bro, get out the vote and replace the militarized adversarial police force.

Yeah, you're gonna get a charge eventually. I'd guaran-fuckin-tee it.

Just because the items weren't on the search warrant does not mean they weren't allow to confiscate them (that's absurd to thing that would be the case). Sure, the plants weren't included in the warrant, but that's not the point, the warrant is to gain access to the property, not a laundry list of things they're allowed to take, and have to leave anything else illegal there and forget they ever saw it. Just doesn't work like that.
^^ yeah this, of course that's not how warrants were intended to function. ideally they would have had to go and get another warrant after seeing your shit which would have given you time to ditch the contraband before they came back but as jurisprudence works now they just fuck you now and use it to charge you later. if they want to. they'll probably sit and wait and see if they can pop you on something bigger. i wouldn't grow there again and i would definitely get your card and move to another county.

honestly in your situation i would consider yourself very lucky.

i mean so what your saying is the cops 'arrested' you and took you to the station, searched your house for a killer (yeah its sucks they busted in your house even tho you were not the killer) then found your fairly large illegal grow and rather than arresting you they cleaned up all the evidence and let you go back home without another word..........

if only they will be so 'nice' to me if am ever in the situation, i will be singing with happiness.

I think I'd make an appointment with a "weed" lawyer. It might clear up the abiguity of your situation.

I just don't see the cop's finding your grow as something that simply goes away. Living just waiting for a hammer to fall or not would be too stressful for me.

Yep, having faced long term troubles on the heath front, as well, it sad to say. But, the only thing worse that knowing is not knowing. But, changing addresses into another state before an charges can be filed is a somewhat less expense than a lawyer. And perfectly within your rights.

Many, including me, would now have a hard time sleeping at night, at that address, sad to say. The other shoe.

I'd say most lawyers would spend 15 min on the phone, for free, when you mention the murder warrant. It's called the initial consultation. I've used that before to triangulate on my rights.
(this state will never give you a gun permit.) OK.

If the cops were interested in scamming free weed then they'd just take HQ dried/bagged weed from dealers.. When I was young, my buddy's dad was a cop.. He'd give us weed that he'd just confiscated without a report from idiots smoking/selling in stupid places.. He said he'd rather give us what we need for the night than have us risk a different cop catch us buying it in town.. (He'd known me and my parents forever, outside the circle that was never to be spoken of..).. Whole plants are alot more work to get away with though.. This guy wasn't a bad cop, just as cool as they get.. He stopped morons from being morons as legally painlessly as possible, but he wouldn't take moronic chances himself either..
