cops took my plants!

ok cops said they had a warrant for a homicide investigation.. the person they were lookin for, well, we have the same address. they came in didnnt find him but, they came across my my grow. they took only the plants left everything else.. they also took a triple beam scale, but nothing else. im sure that my stuff wasnt included in the search warrant. but they took it anyway. i had 2000 watts over i think 14 or fifteen plants..about three weeks to go. in another room i had a 1000 watter over about 7 smaller plants. i also had about 45 or so clones rooted already in a tray elsewhere in the house. they took that too. was that legal for them to do that even if it wasnt in the warrant??

no, and thats what i thought about the most. i recieved no charges either. i wonder how their going to take it. i mean will they come back in the future to see if im growing again and if they do will being legal save me? btw, thanks for the quick reply man!

They call that evidence. But did they say anything that led you to think they were yours or the killers?

Yes being legal will save you.

If they didn't have a warrant for the plants then its illegal. I doubt you'll get any charges unless they sat on your house for awhile and got another warrant.

If they got a second warrant then it is perfectly legal for them to charge you.

As long as they did not take you with I think that is a good sign. (no promises of course)
I would be paranoid as hell to ever grow there again without docs recommendation.

i was already cuffed in a car when they actually did it. these dudes swooped up on me at a business parking lot which is on the other side of alley that i live. i was there ony to have lunch with one of the salon owners. as i pulled into the parking space, just in front of her salon, i had officers,some in uniform, some undercover surrounding my vehicle..
they started to question me about the whereabouts of my buddy. as if i had any clue!? cant give too much info on what their investigation was about but then one of the cops said that they were gonna search the pad. well of course im gonna give them a hard time about giving them any info, even though i didnt know shit, i end up cuffed, in the back of a unit, and we go around the business plaza back to my alley and we came up to my place and i see my door already open. They took my fucken keys out of my ignition! anyway, obviously they seen my grow, lookin for my buddy, during their investigation. i spent a few nights locked up at the station. i was never put under arrest, they questioned me and when they released me, they gave me this stupid paper i had to sign that i was only detained, not arresteded!!!and off i go! Its been almost a week since that day. the person they were lookin for turned himself in with his lawyer yesterday. i wanna know since i had nothing to do with the investigation in the first place, what happens of me. I lost a few days of work, my shit gets ripped off, lots of hard work just shitted on!!! to all fellow growers what do i make of this situation??? thaks for all your inputs!

If ur grow was not legal and u havent been charged or nothing i would think they are probly smoking ur shit up now but i would just be happy u ent getting charged because it sounded like u had a lot of plant numbers i dont know about ur laws but in the. Uk u wud probs end up doing a stech for that cut ur losses and move on and i would be cautious about growing there for a while just in case they come round to check

Just because the items weren't on the search warrant does not mean they weren't allow to confiscate them (that's absurd to thing that would be the case). Sure, the plants weren't included in the warrant, but that's not the point, the warrant is to gain access to the property, not a laundry list of things they're allowed to take, and have to leave anything else illegal there and forget they ever saw it. Just doesn't work like that.

when dealing with police in any situation the best thing to remember is, yes sir, no sir, i dont know sir, not at all sir. most people talk themselves into trouble.

No charges? Count your fucking lucky stars. Drop it, don't bother the Police. Move your grow, get some new plants, and keep your mouth shut .

I prefer "I have nothing to say" and hand him them my attorneys card..which states you are not to question my client without my presence

You didn't say where you lived titobhoy but if you we're growing illegal, I doubt you've heard the last of it. I know a guy who's house got raided while he was away and the warrant for his arrest was issued six months later. If I was you, I'd go see a lawyer NOW!!!!!! At the very least pick one out, tell him the situation, and when the arrest warrant comes you'll at least be ready.

On the other hand, the cops may have overstepped their bounds and they know that, so they didn't charge you. I wouldn't count on it, but you could be lucky. Never ever grow anywhere that your name is on the deed, lease, rent agreement again. You are on their radar for sure so they will come knocking again.

You did not give them the info they wanted so they F'ked with you. Without a warrant specifically to seize your plants, they cant charge you for what they found. Thats why they just took the shi.t without arresting you. They could not legally. Cops can detain and confiscate at will but they cannot arrest or enter proof into evidence without going through the proper guidelines, guidelines that those cops did not follow. They cant even use what they took as evidence because the means in which they obtained them was illegal. You F'ed with them (in their opinion) by not giving them the info they wanted. So yeah they took your weed to F with you. You are an illegal grower though, this they know, so they are thinking this, "what is he going to do, tell on us? He really going to try to tell the D.A that the cops took my illegal grow illegally?" You are fine, they will not come back to arrest you. Just get legal and start growing elsewheres. Also, only grow what the doc recommendation allows...

If they had an arrest warrant to enter in order to pursue a suspect then your grow op as you described it is obviously in plain sight..
