Cops raided my grow room, took everything but never even found 1 plant !!!

I would definitely get a lawyer. Without proof of that equipment being for illegal use they may have just committed theft. And it sounds like they might just be trying to scare you into not doing anything so they get away with it.

He said he didn't have any weed growing or seeds, so he wasn't doing anything illegal, except for maybe stealing shit from people in his neighborhood.

you can get your stuff back but you need to ask yourself is it worth the trouble.i was pulled over and my buddy had a bag (this was a long time ago) anyways the cop finds it charges us both takes my car.they drop my charges so i go to get my car then two police come in and arrest me saying the city droped the charges but the county picked them up went to jail charges droped went to get my car i was arrested again county droped state picked up charges again charges were dropped and i finally get my car back minus my alpine stereo and side window and perelli tires and rims gone.they replaced what was missing eventually but.it was a big pain in the ass and all that took almost 2yrs. so is it worth it. for me it was because it was my car but a light im not sure.

On principle I would go get my stuff.

End your headache now and start over. OR mind wrestle with the G-men and compound the same headache.

If you didn't have any weed seeds or plants, they shouldn't have taken anything. It's not illegal to own grow supplies.
Merely owning grow supplies isn't illegal, but "attempted cultivation" most definitely is illegal.

Exactly where the line is that constitutes an "attempt" is something that lawyers earn their money arguing about in courtrooms, and it can actually vary from jurisdiction to jurisdiction. Still, I think a pretty good case could be made that if you had what amounts to a complete growroom setup, just minus seeds, you've already gone enough of the way there that you've satisfied the legal definition of "attempt".

Just owning a bunch of growlights in boxes and pots? Probably not enough for "attempt", but again, that's something left to lawyers, judges, and juries.

In any case, if the cops took all your grow equipment, and didn't charge you with a crime, then to me that's simple theft.

Tough talk about charging you with a crime if you try and retrieve your property is just that. They're probably just trying to intimidate you. If they think they have enough evidence to charge you, why haven't they done so already? (Answer: they probably know its a weak case, at best). If they've seized your property as evidence, then what right do they have to destroy it? Destroying evidence is ITSELF a crime!

If you want your stuff back, go consult a lawyer. I think you probably *could* get it back this way, though now its a question of "is it worth it"? Lawyers cost money, of course, and the cops will probably try to stonewall, meaning it may take quite a while before your stuff is actually returned.

Unless you're talking about thousands of dollars of expensive equipment, probably the wisest thing to do here, is to let it slide, and get the heck out of their jurisdiction. Even if you sue the cops to get your stuff back and "win" you'll still probably "lose" because the cops can harass you in all sorts of legal, quasi-legal, and illegal ways, and if they decide you're a "troublemaker" they just may want to do that.

This is going to sound "crazy", but if you look at this from the cops perspective, they've actually just done you a huge favor by confiscating your stuff, even if what they did was technically illegal. They've stopped you from committing a felony, AND they didn't charge you with a crime.

You don't need an overpriced attorney 4/this one, sue them in small claims court. But if you go that route, expect to have nice red bullseye on your chest. And did I hear burglary suspicion?, so you already are known to the police.

Fuck suing then, I would relocate.

I'm not under 18. I'm not a legal grower. They came here to investigate another crime and ended up finding my grow op. I recently got accused of a burglary and they came looking for me at my home. I told them I did not want to speak to them and I demanded to speak to my lawyer. The cops then put me in a cell for 72 hrs. They went back to my house to see if I had any of the stolen items and instead found my grow equipment but no marijuana plants or seeds. I called them today and asked if I can get my stuff back and they said to not even dare to go to the police station and ask for my stuff back or else they were going to charge me with intent to manufacture cannabis. At this point I'm looking for a good lawyer who can help me get my stuff back. I do not plan to set up the grow room again in this house. They did tell me that they are going to destroy the evidence they took from me.
If you weren't charged with anything then there is no evidence..only items they illegaly seized...so talk to someone for real...

Legally you can get your stuff back , if there's no case there shouldn't be any evidence.
I would of said I use this equipment to get a early start on my veggie garden. I don't believe growing peppers andtomatoes is illegal
 
The equipment all together was worth around 2000. I think im just going to let them keep them because i dont want to be harrassed all summer by these fucking pigs and i dont have money to move out. If i had the money to move out then I would try and fright to get my things back. Unfortunalty I dont even have enough money for this burgalry theft that i was found guilty in. Soo I guess ima just have to let them have everything. As soon as this burglary case is over and hopefully i wont go to jail, i will go back and buy more equipment and grow my own chili peppers and tomatoes. I already owe 10000 to the lawyer soo i cant even afford to get another lawyer for the equipment they stole from me. hopefully nothing like this happens to one of you guys.

if you steal shit then you are a dirtbag and deserved to be fucked over by the cops, but thats exactly what they did they fucked you. they had no reason to take your shit, none of that is illegal and they had no reason to take it. I would go get my shit back and bring them to court.

Pisses you off when someone takes your shit huh? Remember this when you go to steal someone else's shit.Im sure your not a Bad guy but no one likes a thief.
