1) This doesn't exist - It's separation of church and state.
2) Feds have/can/will fuck with state's laws/constitutions because Fedaral Law trumps all.

Separation of POWER between states and the fed. The sup court could not touch states that make MED MJ legal directly or if it's in a state constitution. The only way they can and have struck down MJ laws is by commerce clauses . A shifty, chicken shit way around it. If The Alaska privacy law were unconstitutional than the the Supreme court of the US would have struck it down, which they haven't. I'm saying this is the key to getting MJ legalized. To have it as a right of privacy. This is where subjects like gay marriage comes in....letting the states decide.

New Jersey would have to be the worst i would think. The only reason being is that i've been busted there, and people i know have been arrested for a slew of stupid reasons unrelated to drugs or violent crime. Delaware has archaic laws however, Almost every interaction I've had with a De cop was positive. I've had them drive me home over state lines. Drive to a gas station while being looped outta my mind a and spilling gas all over their car. I've even been pulled over, putting a blunt out, no windows down ( they were all broke) while the girl and i had warrants. The cop never mentioned smelling anythiing. and sent us off with a warning about my seatbelt. I thought i was going in for sure. all of these instances were De State Police also.

Well, demographically speaking, I would imagine the state with the most senior citizens per capita in it to be the absolute worst. I say this not as an insult, but 99.99% of all the senior citizens I have ever known have all been very strongly against weed due to their upbringing, government laws, propaganda like Reefer Madness, ect. And about half against alcohol even. And as we all know, the senior citizen community always has a very large showing at the polls during elections. So, the state with the highest population of senior citizens per capita is Florida with an estimated 2,897,383 seniors or 17.0% population of the entire state.

I live in Canada and feel very sorry for people going to jail over pot just recently they found over 1600 plants with a street value of approx 1.9 million and the guys were released the same day with a promise to appear and will face a maximum of 3-5 years in jail if that. Now thats how it should be not 35 years for 1 plant that makes me sick.

A law doesnt get challenged it doesnt go to the supreme court montana has a weapon laws that hasnt been challenged but itsreally does go past fed limits. Second a privacy laws and a drug law are 2 different things once the bud leaves your house then the privacy law does not matter anymore. The constitution says federal laws trumps state laws . So please read article 4 of the constitution and the 14th amendment. To sum it up for you 4th amendment says what states can do 14th amendment was made because of the civil war and staets used article 4 to suced from the union. 14th amendment is basically a common good amendment to prevent "rogue states".

To answer the original question West virginia and Nevada are the worst states any amount is a felony:leaf:

I know someone who got busted with 60 pounds in the trunk of the car. They said nothing to anyone, got competent lawyers and spent 60 days in county. This happened in UTAH!

For putting a seed in dirt and getting a sprouting is more than enough to put a guy away for 30 years? How can cannabis smokers even want to live in a place like that?

Utah. Mormons and their hypocrisy. Mind altering substances i.e. caffeine, THC, nicotine, etc BAD.... Pills abused and not taken as prescribed OK because a doctor gave it to them..... WTF. On more than one occasion i've seen people charged for a drug DUI for having only a dirty pipe and no weed in the car. They took their license for a year and when they got it back (after fining them out the ass) they put the breathalizer thing on their car (which they had to pay for every month)...... and it only works on alcohol..... retarded. That and the legal system is a trap here. Guess who hates Utah?

What are people's opinions of the best and worst states to be busted for growing or smoking herb? The best will obviously be Alaska or California, although the laws are a little grey, there are still difficulties in possessing large amounts of cannabis in these areas. However; what is the worst state to be fucked in? I might have to go with NJ or Delaware. Possession of any amount of herb will cost you a year and a thousand dollars. Anyone else agree or are there definately worse?
im gonna have to say missouri. they dont call it the show me state for anything. i got poped there way back and they tried to hit me with 10-25years, for my first offence. with a lawyer i got it reduced to a class B felony and offered me 7 years. i took it and spent a year. with 5 years paper.

I used to live in a southern state before my work took me north; not as bad as some have claimed. There's a long cultural history down there of growing weed going back to colonial settlement. If you have a clean record, a first grow bust is usually bucked down to simple possession - a fine, basically. As long as they don't find unpermitted guns and stuff put into bagged quantity, and your record is otherwise clean.

I had a buddy in Arkansas get busted. The cops made a big deal and trashed his gear during the bust; acted like they just caught Bin Laden. Got off on a basic possession charge.

Colorado is great under an ounce is 100 dollar fine no jail time no standing in front of a judge just give the court 100 dollars and that's it if you don't have you license and its easy to get a medical marijuana license where you can carry and grow marijuana legally in my small town there are 2 marijuana dispensers and at one there's a doctor there every Sunday basically giving out medical marijuana license literally took me under 5 minutes to get mine there told him my back hert and i was sick of going to the chiropractor and he handed me my license easy as that

although some states have differant laws, some stricter than others I think that in every state theres the little town where everybody knows everybody bullshit and if your liked in town the cops look the other way,not every cop out there has a personal vadetta angainst pot smokers either, lets face it most of the time whe people get caught they say I was in the wronge place at the wronge time.and that maybe true in there eyes but the law is the law and its up to the cops to enforce the laws.geting caught smoking in a place where you know you shouldnt is only going to piss the cop off and then guess what happens.as far as growing if you making money growing by selling lots of weed then thats the chance you take so be sensible and be carefull
