Thank you South Texas for keeping us updated. I live in Texas too, and I dont know anyone who has personally been busted for a growing operation.

I always wonder what will happen if I get busted, and your thread helps me keep everything in perspective.

Peace brother, maybe one day Texas will decriminalize and we can smoke a fatty together.

Roaches in the house really sucks. They slither into your cupboards under the cloak of darkness. Behind your back. Hiding in plain site. Camoflouged behind a cheap suit & a business cards. Preying upon the crumbs of social ignorance. Portraying themselves of being Saviors of the downtrodden. Shelter from the Storm, for all of Humanity. A simple social parasite that thrives & breeds in the heart of ignorance. Enlighten the masses with God-Like wisdom.... "The DA is really pissed at your crime...., He or She is taking this personally". Not just Texas, but in every State. Same ole' tactic. This, People, is a problem. Our most self imposed handicap is adopting a defeatist attitude. There is this very awesome professional ( And I do mean Professional) effort to promote a defeatist demeanor. The term, "You can't fight City Hall", ring a bell. or "The Judge will do whatever he wants to do". ???? Or, to the Point, take the 10, or the DA will assure that you'll do 25. Houston, We have a problem. Two things to write is big letters in your road map to Life; #1. (John Lennon) "There is no problems, just solutions". #2. It all boils down to Human Nature. There is 7 simple steps to Due Process. Simple. There is, also, seven basic steps to beware of in Human Nature. Specifically, Law Dogs. Drape a dyed piece of cloth over their shoulders, place shinny, reflective pieces of metal objects to adorn the head, shoulders, and fat asse'd belly..., now, what have you got? Some people see a Law Dog. Pull back the curtain..., what have you got? A person so deviled of any redeeming qualities, that their own self importance relies soley of colored cloth & trinklets self adorned. Set back & see the farce, as it really is. Part One.

To unveil the hidden facts, a light of is the key. The tricks of the trade, for them, is ignorance. The weapon of choice is truth, for us.The blinding light of truth & reality that plainly shows that the Emperor truly has no clothes. Here is the facts to shine the light on the Roaches.
Every Citizen has the right to a Jury Trial. However,.... due to the amount of arrest, & due to the time invested, the Courts system, as it has stood, & now stands, does not have the time to afford each accused person of that Jury Trial right. That is their problem, a very serious problem. Their options are limited, but there still is options. #1. If the person is not a threat to you & what you love, let them go. If a person made a stupid mistake, and has an 80% odds of not fucking up again, LET MY PEOPLE GO!!!!" But NO, In the real world, the job of Probation/Parole job pays for the cost of Law School, the "conviction record" paves the way into Political Office- Judge, Etc. So what we end up with is a Military term called FUBAR- Fucked up beyond all recognition. Fact is; Out of every person arrested for a felony offense, the Court schelule only allows time for 20% of all of the persons afforded the right to a Jury trial. But We all have the right to a Jury Trial. Instead of,... The DA is really pissed,.... how about, I'll break this piss poor financial system, impose so much muddy waters that a win will cost you your buget for the year, for a 3 year sentence. Only on Bail. To use this weapon, "There will be NO Plea bargin on the table". Each Court Aptt. Atty is paid $250 or more for each Plea Agreement, (By the State). If He/She does not meet the DA's demand, then that Court Appointed Attty is taken off the list, no more BMW car payments, no more Golf Fees, etc. End result, a premeditated goal is to plea, everybody is happy, while you do time. Cold hard fact.
Leverage. (In my case). Settle out quick, or I will break this County, leaving your Offices in Prison- (Once the Barny Fife Sgt. set foot on my Property, he done so without the protections of color of Law. The Immunity granted by Legislate was dismanteled. Legally, I could have blown his head off. Some people may understand the acts committed without the protections of acting under color of law, it's basis is the Seperation- 3 prong- of powers.
In Texas, the statute still remains that ... You can pick the Juries, OR .. Have a list of names put into a Hopper, like Bingo. Just for fun, "Let's Rock!!!!"

This is the internet, and even though you only asked for my opinion, Im sure more will chime in with their two cents and the next thing you know you'll have a serious threadjack issue on your hands.....

But since you asked here is my two cents.

FDD does the job Rollitup wants him to do. Even though people dont like to see threads closed/deleted, or banned members, it's FDD's job to do so. He is alot more lenient than most people think. He even reverses infractions immediatley upon request. (He reversed 420oldschoolBJ's infrations, even though he definately deserved them.)

Even I have been upset at FDD from time to time. But thats what happens when you become an enforcer and actually enforce rules. I think we should all give him a break, nobody is perfect. If I were a MOD, Im sure I would have haters too.


I guess what Im saying is sometimes you have to take the good with the bad, and FDD has done alot of good for this site.

I know that the law says a cop can't enter your residence without probable cause. I also know that you have to be placed under arrest to be "resisting arrest." My dad recently got arrested for resisting arrest. I know that makes no sense, but some cops are seriously retarded. Even though my dad "won" the case, he still has to deal with lawyer fees and court costs and is out several thousand dollars. He knew his rights and he did nothing wrong but he still got screwed. The case did get dismissed though.

Some cops think they're obviously above the law. The above story happened in Houston. I also used to live in TX and while I know a cop isn't SUPPOSED to enter my residence, I still locked the door when I used to keep lbs in there. Why? To avoid trouble from stupid cops who don't know/don't care about the law. Sure, I could have left the door unlocked, maybe giving a cop a chance to enter illegally one day... knowing that I would get off on "Illegal Search & Seizure" but do I really wanna go through all that trouble as opposed to locking my door? Hell no! I'm not sayin you should or should have locked your gate. I'm just tellin you how I feel about it. Why tempt fate? Unless you have the Bernie Mac "I wish a motherfucker would!" attitude, which I definitely don't lol. My buddy has a ranch outside of Houston where he used to grow shrooms and MJ. He would always keep the gate locked just to be safe. Maybe Houston itself made my circle more paranoid than you, idk.

I respect what you're doing and the way you operate but I would much rather make the cop jump my fuckin fence because I have an actual lock on it than to let them stroll up to my place and take all my plants (even knowing that I'm right and I'll get my stuff back).

You are absolutely correct, in that you describe. Believe me, I've beaten myself up over this exact same issue. The "LOCK" is big issue. Reading & understanding the Law is cool. When the shit goes down, that's where the Monday Morning start, or, will stupid words on paper save my ass. Here's food for thought.
In your logic, pad lock the Gate, front door, windows, chastity belt on you, wife and/or kids. Why?? Because prior written notice, you know, that silly thing called the US. Rights, ststed that if you post signs, & met the requirements, which mandates, 5 strings of barbed wire, and a sign to establish that persons desire to envelope themselves under the protections of the US Const, and all laws there after, is mandated to follow suit.
So,... if the lock will deter, do I need locks for my front door, or my windows? What your reasoning is, IS EXACTLY what I ask the Law Dog, once He set the shit in motion... "What gave you the right to walk upon my property?" Stupid Bitch said "The gate wasn't locked". I use a spring loaded clip to secure the gate, 50 cows. They do not read the English language, they have not a concept as to the prior notice laws. The secured gate is for illiterate cows, the posted signs is for literate law dogs, which state, No Trespassing & "Keep Gate Closed, Pleased". Seriously. In short, the secure gate is for cows, the signs are for the Law Dogs, no more, no less. The posted signs meets my burden to drape myself, meeting the burden described by the Law making Body, within the blanket of the US. Const. To allow, acept, is no less than the SS Nazi's to ... what? Shoot what moves in your House.

The Constitution and the Bill of Rights are nice and all but with the US Patriot Act in place, we've lost a lot of the rights this country was founded on... and the scary part is that no Congressmen actually read it before signing. I'm sure you've read quite a bit on the Patriot Act as well. What's your take on that?

Define for me, in "Black's Law Dicinary" the Difinition of ( not reasonable, but) Probable Cause. A reasonable/Probable Cause lays before yhe Judge, unless there is immediate threat. The Judge invisinons the Blind- Folded Lady with the Scales. Or, His career. Either one, no warrant. Without such, all BS is BS, ubless immediate threat to manknd. Yes?

texas can you relate anything that has happened in court (im sorry if i have missed it i looked)
Thus far, just to be assigned Counsel. A week later. I called the Bitch, ask about police report. He's said, while his Asst. was with him, on the phone, that "He wasn't concerned about my 10 years because He is defending others with a life sentence & a 30 year sentence." Seriously. It took Him several minutes to realize that the call could have been recorded, & His Asst. heard the statement. So, He had the Asst. to call me back, trying to do damage contol. Next step, I'll ask that He recuse himself. He wants me to send him a written statement, so he can run to the DA with it. Thus far, they have not a clue that original entry was illegal. I'm not saying shit until I get the Dude on the stand. With the Enhancement, I want to challenge the legality of the original conviction, which was wholly unlawful. Well, people, Y'all tell me. (I know the answer). I made a contractural agreement with the State, Deferred Adjudicated Probation for a plea of guilt. Cool. However, something happen that has never happen in the history of Texas law. Closes cases is exparte Spain & Morgan, conflict of interest. My Probation Supervisor passed the Bar, hired by the DA's Office. Her very first case to prosecute was,... guess. Yes, that would be me. My Court Appointed Atty. told me something about a conflict of interest, & He would bring it up, & I would walk out. I didn't know what the hell that meant.... He said nothing, My Probation Officer played a duel role as prosecutor, I done 5 flat because of that. 2 offenses, one said failure to report, the other said failure to pay. My dumb-ass, I stated that I didn't have the money to pay, I met that burden, so, in the Court, The Bitch crossed out Failure to pay, & wrote in Failure to report. Seriously. Of course I reported during the time in question, signed the sign-in sheet. My Atty. refused to get a copy. They switched Probation Officers on me without notice, so when I reported, I ask for so in so. They said she wasn't in.... I ask if I could leave a message that I was there... They said their job is not act as my personal Secretary. What I did not know, what the new Bitch did not know, at the time, that she was waiting on me down the hall, passed a door that said no entry without an escort. When I stated in Court that I was present.. The Bitch realized that I was there to report, but didn't know to ask for Her. She made a decision, get busted for playing a duel role, or have me locked in a cage for up to 8 years. Yeah, off to Prison I go. So, I do have a hard-on for BS Officers of the Court.
A few years back, I contacted a Law Professor..... He wanted my case, after the Semester, because he was teaching for the State, conflict. He wanted the case so He would be published in the Law Books. Just before the Semester was over, He went to the Hospital for an ulcer. Got Phumonnia, was released, died of a massive heart attached a week later. All the above is documented. Prison Counsel told me to keep my mouth shut & do my time. Am I a lucky Guy, or what? I always made my child Support, was paid up on the day of going to prison. The amount said I owed when I got out was $47,000 bucks. Oh Yeah. Now, the Enhancement. John Grisham's Books come to mind.
