Questions About Probation

So here I am, sitting on over a gram of pot and a bong, but not sure whether or not to smoke.

I have court coming up in a week for a charge of possession of drug paraphernalia (but no drug possession charge). It was some bongs and marijuana smoking shit, nothing really bad like meth pipes or syringes anything (I don't do that stuff). The public defender told me I'd probably be put on probation since it's a first offense. What do you think the terms would be? Six months? A year? More? How often would I be drug tested? The defender alluded that it would be infrequent tests over a year, probably about 3 or 4 total. So that puts it at a test every few months or so, if he's right. But my main question is... would they test immediately after sentencing me to probation? Like... the day of court, or close to it. Do they usually do that? Or does one not get tested until their first meeting with their probation officer whenever that happens to be, a few months down the road?

I'm sure they will give you 6 months max of probation. And when I was on probation, I got drug tested on the first meeting with the probation officer, not the court hearing or whatever. But your lucky, I had to get drug tested whenever the bitch felt like calling me. lol.

It might be like that, idk. It makes more sense than scheduled probations... I mean if I wanted to catch someone when they're not clean that's what I'd do. Call them randomly.

But 6 months would be bearable, I guess. It'd sick to not be able to smoke the whole time. How did you handle it? Did you not smoke your entire probation sentence or what?

And how soon after court was your first probation meeting?

Depending on what state you live in, i live in nebraska, and im on probation for 1 year for a non-drug related incident, and in nebraska, they assign you a number (1-6) and you call the number they give you and they will say on the recording (1-6) and depending on what number you are (myself being 1) depends on whether you have to go in on wednesday between 9am and 3pm to take your UA. But its subject to change from state to state. I would hold off for awhile, when you go in for your baseline UA, if it comes up positive, they cannot hold it against you, but they are more likely to test you the week after and that will most likely be positive. 1st offense here is 1 day jail time, second offense here and every offense therafter, 3 days jail. BUT if you fail a test and they give you a retest within thirty days, they cannot hold it against you because its scientific fact that marijuana takes up to thirty days to clear your system, but just play it safe and stay clean if they give you UA's, because i thought i could smoke and get away with it and there is no way except not smoking, ive tried everything. Just thought i would add my $.02

UPDATE: So I got a year of probation and fines out the ass, and of course was not tested at court (dunno why I was worried about that). Waiting to hear from the probation service, I guess.

they dont test u cuz u have a drug related charge and figure u are dirty but they most likely will in one month and they dont follow a schedule its random
and i known of them to test u then test u again next day
cuz most think shit im good to smoke i just got test then they get u next day
i know it sucks but best to wait them out

in my experience each probation officer is different and when i was on probation my officer would test me whenever she wanted..(lucky for me it wasnt often) but i would say try to at least stay clean til they test you and even then only smoke as little as you can to satisfy. if you could i would stop i hate probation!!!!! for real it depends on you too. you dont take an attitude and be as real to your officer and they appreciate that more after dealing with some people who go in there and give them a bunch of shit. be cool and maybe if your lucky youll get a good officer!

Yeah of course, I'm not risking getting my ass in jail for violating a conditional discharge... I can wait a year without smoking (and it also means I'll have a very good reason to uber cure most of my yield!)

Yeah, I'll just hold off for a year. And I'm usually a pretty cooperative dude, I never give cops trouble. I don't like our government but it's no reason to take it out on the working class. Cops are just people trying to make a living, too. Though of course there is that percentage that got the job just so they can give people a hard time, but I'd never make that a generalization.

Question - they can just call you and have you come in whenever? How much notice do you get? This will really complicate things because I'm working full time now... I can't just be calling out of work left and right

As some one who dealt with my state for close to 15 yrs.....prison,co. jail,probation,house arrest,consecutively, here is my advice.

Stay clean.Sure there are ways around piss test and all but what you put yourself through is not worth it.The worry of "am i gonna get knocked off" will stress you to the max.

6 monthes or even a yr of our lives ain't shit.....do what ya gotta do and be done with it.

and im not sure about where you are but here they tell you when your next appointment is and then if there gonna test you they test you then..

well then where u live they r lazy
most cops have to start as probation officers or prison guards for 2 years or go to college so most PO's or pos want to make a name for them self
dont chance it

of course if you get get some hard ass youll know better than to push your luck and my advice was to quit smoking all together for best results but both times i was on probation I DID NOT PERSONALLY get drug tested accept on the day that was appointed the month prior to be my next appointment but i am most positive that they can call you whenever and make you do whatever that is the privileges of probation they rule you but it was never ever like that for me. anyways sorry your in trouble man and use your head. if they feel like it they can change it up and test you whenever.

once when i was on it had a cool po but he went on vacation and dick who took his case load for a week pissed me but my po was chief po an guess his fill in had to make show and felt he had to be str8 ass

How far in advance do they have to give you notice? If I'm scheduled to work the next day, I can't just call out if they decide to make me come in and piss for them...

A year of probation for paraphernalia?!!! Jesus Christ!! That is fucked right up. Sorry to hear about your luck.

I got a year's probation for a mischief charge when I was younger... I caused over $6000 in damage - You, at some point, smoked a bit of weed... I can't imagine.
