Need Help! Ca Mmj Compliant! Apartment Inspection!

In California, there is NO RIGHT TO GENERAL INSPECTION, even if it is written on your contract, that section is null and void.

See California Civil Code sections 1953 and 1954.

Under section 1954, the landlord can ONLY enter the unit for these four enumerated reasons:

(a) A landlord may enter the dwelling unit only in the
following cases:
(1) In case of emergency.
(2) To make necessary or agreed repairs, decorations, alterations
or improvements, supply necessary or agreed services, or exhibit the
dwelling unit to prospective or actual purchasers, mortgagees,
tenants, workers, or contractors or to make an inspection pursuant to
subdivision (f) of Section 1950.5.
(3) When the tenant has abandoned or surrendered the premises.
(4) Pursuant to court order.

(section 1950.5 is the pre-move out inspection, and is not relevant to periodic or annual inspections)

THERE IS NO RIGHT FOR LANDLORDS TO MAKE ANNUAL INSPECTIONS IN CALIFORNIA, PERIOD.
It does not matter if the insurance carrier wants it, or a city agency wants it, the tenant's privacy can not be violated except in an actual emergency. Inspections REQUIRE the voluntary cooperation of the TENANT.


Under section 1953, even if the lease or contract says the landlord can make annual inspections, that section of the lease is void. The tenant cannot be made to waive their rights under California Law:

(a) Any provision of a lease or rental agreement of a
dwelling by which the lessee agrees to modify or waive any of the
following rights shall be void as contrary to public policy:
(1) His rights or remedies under Section 1950.5 or 1954.

So even if the lease says the landlord can come in annually, bi-annually, or periodically for inspections, they still must abide by section 1954, which does not allow for *any inspection", and the tenant can refuse the inspection.

Further, no agency of the state, city, or federal government can inspect an occupied apartment dwelling without a warrant issued by a judge upon probable cause. Any request to inspect requires tenant cooperation and approval.

Inspections REQUIRE the voluntary cooperation of the TENANT.

I never heard of any leasing nazis that went around inspecting their little investment property so vigorously! that is a real risk to the ladies, as everybody knows that when a square inspection agent lays eyes on a nice stinky herb garden that's not legal, he might as well be looking at a stack of child pornography. Now about your problem .... couldn't you just build an emergency stealth box like out of an old 6 drawer cabinet? you just got to hide 'em, and not in the closet or the cubboard I guess, those are too easy giveaways.

your best bet is to move your shit man. They might not have the right to inspect your tent like snow says. But they do have the cops phone number. And a warrant is way too easy to get these days. Your kids are of the most concern here. Now i have had the chief of police and the narcotics task force come to my home to inspect and approve my set up. As long as you have everything under lock and key, you are fine. Make sure its all locked up man and you will be fine.

So heres my problem..Live and grow in my apartment. Grow in my master BR. Have a cabinet in my kitchen set up for clones/sprouts etc. In Master BR..1 4x4x7 hydrohut with 9 plants about 10 days to chop...secret jardin 2.5 x 2.5... with 13 veg plants..in my kitchen cab i got 16 sprouts like 5" tall.
From what i hear they go through all your rooms and all your cabinets etc.

I have a few concerns here as i have my kids in the other room. they have no way of getting to my plants or my weed or anything and i dont even smoke in front of them but im worried about cps. i have heard of people getting their kids taken away because of prehistoric laws and attitude towards the best medicinal plant on earth.
also the inspectors might rob me when they see what i have.

I take my health seriously and dont take anything not natural not even tylenol. I also dont believe kids should be subjected to any drug until they can make theyre own decisions ya know what i mean?

So damn WTF do i do? Im kinda cool with the manager i was thinking of in advance just goin in there and droppin that on her. maybe ill just have to hook her up with some nugs once in a while...

any suggestions?
