Let’s say someone used to grow...

What if a fella in a no grow state grew at one time but not anymore. Let’s say he still uses his equipment for legal plants. What are the chances of being charged if someone like say a vindictive wife during a divorce tries to destroy him with any and all evidence she can come up with.

Asking for a friend.

get rid of any paraphernalia, and don't keep anything illegal around the house till the divorce is over. there's no law against growing houseplants and veggies. they can look at lettuce all they want, as long as its not the devils lettuce.
as far as her implying it was used for illicit purposes, she might be reminded, maybe from attorney to attorney, that if she can prove anything, she will also be proving that she was complicit in the situation....

Yeah all of it has been long gone since before the divorce. So much so there has been full size vegetable plants grown from seed under the lights. I guess the main concern would be if she was able to produce a picture. Not sure if she can but think she has the idea that some deleted messages and photos are going to get recovered from her phone. I doubt they would find much but Incase they did. Either way the the lawyer knows about it all and won’t let him purger himself but doesn’t think it’s the end of the world.

@Roger A. Shrubber is pretty much right on the money.
She'd be shooting herself in the foot in snitching you out. But I've also seen women not give a crap about collateral damage.
As far as the photos are concerned that would all depend on whatever data recovery your wife's signed up for. If not then the court COULD subpoena it. I'd say the chance of that is pretty damn low unless you were some sort of mover and shaker.......which she would have been an accomplice to. If there's no data recovery (online storage most of the time) then once it's gone it's gone without some hard core forensics. And even that can get scrubbed over time on the phone itself just by deleting old photos and replacing the data area itself enough times. It becomes far too corrupted to recover. Don't believe everything you see on CSI and Criminal Minds.
Any paper trails? Seed orders paid for with credit and debit cards etc? That'd probably be the biggest liability.

If I were you though I'd probably lay off growing herb indoor for a long ass time after the divorce if there's a house/property in play. Stick to guerrilla growing if you have to but keep NOTHING at home.
I've had an ex actively try to get me popped up to a year after we had split. Had cops show up ASKING if they could search the place on nothing more than "anonymous tips". Told em to fuck off. Get a warrant. Took my dogs out back and chained em up. They got a warrant signed/faxed in 20 minutes. Never left where they were parked out in the street. Turned the whole place upside down and came up empty handed.
I'm honestly surprised nothing got planted there. But they went through hell and high water ripping apart a closet I had previously kept some seedlings in when she was part of the picture. They were focused on digging through that in detail + running serial numbers on the firearms that were there. Which they also went to right off the bat.
It beats getting flashbanged and chucked out on the front lawn at 3am though.
It was funny when they popped the tool shed door open and figured out the reason I didn't go out there was due to the Wasps that had taken up residence inside. Fatty cop got nailed and the little bastards kept dive bombing him randomly as wasp do after they tag someone.
A few other random BS encounters in that time frame as well.
Out at a barcade. Ran into two of her friends that were a couple. Got the stink eye a couple times. I was DD for the night. Left later and got blue lighted in 5 minutes. There was a report of my vehicle "driving erratically". Plates and all. Had to deal with that hassle. They were in fact tailing me and keeping their distance.

Yeah I pretty much figured. Honestly I don’t think that anything will be recovered from the cloud. As devices where never backed up to the cloud except for contacts and maybe emails. Everything else was synced up to a Mac and she doesn’t have it.

Should be golden then. Dhs has even seen equipment with veg plants and didn’t seem to care none to much.

You aren't the only one growing veggies under HID.. you'll be fine. Even if she does have pictures. If she got pics on her shit it means she was growing too. She'd have to be super dumb. Good thing you got out of that relationship
