I very much hope that one would not be eligible for unemployment if one were fired for thc. Those are my tax dollars, and I have no interest in paying your way. A paper cut will get you a drug test, a forklift fuckup will get you a very thorough drug test, and you knew that going in.

If you test positive, you will not be eligible for unemployment. The fake piss is a good idea, you don't have to carry it everywhere with you as your employer must give you 24 hours notice before the test

If you work at a big one chain call another one nearby and ask their HR person the policy without identifying yourself. The HR person is the one who knows whether or not you will get your unemployment. They have to approve or deny paperwork when you file, as far as I know.

I asked a supervisor who i know smokes to ask her. he did and the HR lady said she'd have to look into it. He asked the big boss as well and he just kept pressuring my sup. to tell him who it was, so i dont wanna press the issue.

Have you read SB129? Basically it boils down to they cant discriminate against medical marijuana users with the exception for safety sensitive positions.

Yeah... SB129 has not been passed. Its in the pipeline still but has been delayed until at least January 2013. WRITE YOUR REPS AND TELL THEM YOU SUPPORT IT!

There was a court case in CA a few years back where a radio station employee was fired just for failing a random drug test even though he had his doctors rec.. He was considered a good employee and had no issues with his employer at all and wasnt even caught high at work. His company was purchased by another company that required all employees pass a piss test so they made all existing employees do it too.. He told his employers he wouldnt pass before the test and explained he had used mj and had a drs rec for it and had been medicating legally for years. His bosses were all cool with him, but he failed the test. The big corporate peeps fired him anyway. It went to court but he lost and lost his job.

So in other words, with current laws, you don't even have to crash a fork lift, they can fire your ass just for being a patient if your bosses don't like marijuana or you piss off the wrong person. All you gotta do is not pass a drug test, and in CA they can pretty much make you take a pee test whenever they want.

This case led to SB-2279 which was really similar to SB-129. SB-2279 made it through the legislature but then got vetoed by THE GOVERNATOR. SB-129 is the latest attempt to protect patients right to work. WRITE IN AND SUPPORT IT!

Maybe I'll start a thread with info on the issue and and how to email your reps and the Gov.....

I don't mean to bum you out but, I was a manager for a produce distribution center. When ever we had any accidents tests were mandatory. The only thing that saved them was the tests were unsupervised. So they always took clean pee with them to it. After that it was finding something else on them to fire them. One guy crashed a truck took his test, passed even though he smoked. The owner wanted him fired anyways. The driver took the truck when we were closed and had it fixed out of his own pocket. He never took another test again, and the owner loved that guy after that.

If the test suggests you were medicated at the time then I'm pretty sure you can be fired.

For a accident they take you before the ink is dry on the accident report, what have you been smoking.

As someone that has worked in the heavy equipment industry for over 20 years, I can vouch for this. It's 100% true, and it's the reason I keep a bottle of Quick Fix in my truck at all times.

I need my job.

sugar you dont have to pay the way of others if you dont want to. i haven't failed any piss test, or crashed the

forklift for that matter. i just wanna figure out if im legit or not, and from what i've read in this thread, im obviously not.
