I was stopped for having a pine-tree air-freshener in my rear view(bogus cause).
The officer said he was going to search because he smelled marijuana.
I informed him he had no probable cause to search.
I am legally entitled to the 'contraband' in question.
After I refused the search and showed my recommendation for
marijuana, I was placed under arrest for 'disorderly conduct'.
After the search of my vehicle. I was cited for possession of marijuana,
obstruction in the rear-view, and disorderly conduct.
The DA, after reviewing the evidence, dismissed all but the obstruction in the rear-view.
I pleaded not-guilty and the cop didnt show up so that charge was also dismissed.
Moral Of the Story:
Stand your ground.
Do not admit to anything but your name.
Fight it all the way.

Careful.... Careful..... What are his damages? Being deprived of MJ for a while would not win enough money to even bring a suit to court, let alone finding a lawyer to take the case. If you could find one, @ $250+ an hour, you'd wind up owing the lawyer.
A lawsuit, in this case, is a good idea, in principle, but, not in actual practice.

I hope you are filing a complaint against the officer for unlawful detainment, bogus charges, lying and the mistreatment of a law abiding American who pays his taxes. (Your tax dollars pays that cops salary.) I also hope you are filing a complaint against his supervisor for misconduct and failure to supervise. File one complaint for each separate item. This cop is stealing from the public and he has motif and opportunity. His motif is all the overtime he can rack up and his opportunity is highlighted by his behavior of knowingly and willingly created false charges that imprison people.
For a few hundred dollars you can file police corruption charges in federal court. File it against the Chief of Police; after all the buck stops with him and the 'tone from the top' comes from him. And the message he is sending to his officers is this type of illegal behavior is acceptable.
If we do not take a stand and file these complaints these cops will continue with this passive aggressive behavior.
After you are finished with that you should file a complaint against the DA with the California State bar and ask that he be disbarred. Do you enjoy having your valuable tax dollars being diverted from other community improvement projects for this bullshit?
Just think how much over time that cop was able to rack up. Just think how much time was spent in the court system for this crap. These are tax dollars that will not be spent on improving our roads and educating our children.
Then file a complaint against the Chief of Police for fraud, failure to lead, intentionally misleading the public and misappropriation of tax dollars.
If others would have done this before you then maybe it would not have happened to you.
At the very least contact your local ACLU office; that's what they are there for. And do a Google search for what constitutes damages in the legal system. I know I would be suffering after being thrown in jail with violent criminals and being lied to. How on Earth could I ever trust my local police department again.
Was your car impounded? Did you have to spend time and money getting it back? Was your car damaged, dings in the body that weren't there that you would have noticed from the weekend earlier because you hand washed your car.

It would be nice if he could get his defense costs paid for. Everything was dropped, he got his stuff back, but he is still out of pocked for the lawyer...unless the lawyer was provided free by the courts.
He would not be out anything if they never tried to charge him in the first place.
What is the point going to the trouble to get a MM card if it doesn't mean anything and you get arrested anyway?

If city attorney or law enforcement refused to return my property, I would have had grounds to move for contempt of court. If I required to litigate the matter by way of a contempt proceeding, I seek costs and attorneys fees pursuant to subsection 1218(a) of the Code of Civil
Procedure.
Lawyers have told me they would work on a contingency basis for such a matter. And people have been awarded upwards of $20,000 in previous settlements.
