Heres an update on my friend. He went to court an they are not filing charges at the moment. He got a missing complaint..

A little background. No one smoked in my vehicle ever. We had less than an Eighth left between 5 people. That was all in the trunk in our trail bags.

We had been on a two day hiking trip. We were all ripe and covered in mud.

My friend was smoking a rolled cigarette when I was stopped and he immediately thought it was a joint even though my friend handed it over.

When I was arrested the officer immediately said he could smell marijuana after I told him I know my rights and detained me. He called back up and I was confronted by each of the other troopers one at a time regarding the smell of marijuana and I requested council and told them I refused consent to any searches of myself, vehicle and belongings. They said they had probable cause and I still refused to hand my keys over so they arrested me for interference with official acts and proceeded to search my car.
