Felon with gun

Ok so a buddy of mine got arrested this week for being a ex felon and having a gun on him. He got pulled over (felony stop) told him he was being detained. He asked why was he being pulled over for and they said taillight was out. He's not on parole or probation. They still search the car and found the gun then they told him he was under arrest. Question is can cops so this? Detain you and search your car for no reason? Not to mention they fucked the car up. Ripped out the backseat straight off and broke the latch on the trunk an now it don't close. He's filing a complaint today.

I would get a good lawyer. If he's good he can get it thrown out.

Claim it as illegally obtained evidence on the basis that a search was not warranted. (not that you need a warrant to search a car, but because they did not have any kind of suspicion to do the search.) (illegal search and seizure)

To search a vehicle the police only need reasonable suspicion that a crime has or is being committed.

The lawyer will obtain the video and audio from the stop. If you're lucky the officer was mic'd

The cops can do anything they like.....it's then up to the courts and judge to determine if it was legal. Unfortunately, a felon with a gun..........they will turn a blind eye just to convict him. I'm guessing he'll get another 5 years. I'm questioning if the tale light was even out???????????

There is more going on here then was stated is my guess.

not true esp from the sounds of this case a good lawyer will get this case tossed and a suit on the police department esp if it was a race thing.

That's what I told him. Only he really knows what happen. I got pictures on how they left the car. Ill post them as soon as I get home from work. Cops in my area are know for shady shit.. There has been numerous complaints on the pd here for abuse and other things. There was even talks of getting rid of the pd here and having the sheriffs take over. I'm in Ventura county.even the police chief was fired on corruption charges but the DA DIDN'T FILE CHARGES... Go figure.

The cops obviously stated why they did a search in the report. I doubt the would over look something small like that.

It is perfectly fine for the cops to do this, which blows... I was walking to work at 7am and a cop stopped me. he told me I had a warrant, which I did NOT, as I had finished community service at the POLICE station for crying out loud. Also I finished my CS a month earlier, which I told him. Since there was an "error" with the paperwork, and I was already detained, he proceeded to search me anyway, and I had about a gram or so on me, which is illegal no matter what (so is being a felon and having a firearm in your possession like your friend, I can't even go hunting right now since I too am one) So I still got arrested, and at the police station he IMMEDIATELY found out that I had in fact completed my CS earlier, just like I had said. I know that particular cop, he is young, and seems to think he has something to prove. All he has done is made me too scared to even visit my parents (I have seen him circling around me numerous times, literally circling 7+ times around me while I walk less than a half mile to the gas station) You could try to post a suit on the police department, but honestly, you will not win, since the end point is he was a felon with a gun in his possession.

lol.. Even cops have to follow guidelines to make something stick.. If it was a illegal stop search & sieze then the case will get tossed. If I was you I would be waiting for that officer to HARRASS me again to get my lawyer right on him from falsely arresting me for a warrant I did not have! It happened to me already:)

Exactly right.......but this still doesn't make it legal either. It's just our screwed up legal system, where you are guilty until proven innocent.

They flashbanged my nephew in his underwear while he was cuffed for growing a little weed. It never made the police report so it didn't happen. Even with remnants of a flashbang that they left behind.
Back on topic a felon in the streets with a gun I have no use for. They clearly aren't bright enough to be a responsible gun owner and are more than likely a danger to the public more than anything else.

Maybe you would be happier if they let the dude go and he shot someone with the gun he isn't allowed to possess let alone carrying it concealed and hot I'm sure.

Sure no one likes "thugs" who do fucked up shit to innocent people. But what do you mean people who resemble thugs? Your a "thug" based on your actions, not how you look. By being "neutral" on stereotypes and not putting them down you only give them power.

I don't agree fully with this. A felon isn't necessarily a threat, or uneducated! People get felonies for simply having a drug addiction and possessing their drug of choice! Sometimes people make poor choices, as a young person, but these felons shouldn't be subjected to the same laws as a thug gang banger with violent felonies! This is another broken piece of the system, Or perhaps it was devised this way on purpose?

If you're a felon and you know it and still carry then you just aren't that bright.although I agree all felons aren't a threat but the ones carrying have already shown they are capable of a committing a felony so....

Thats bullshit man, you have no idea why he had a gun. There is a million reasons some both right or wrong why he could of had that gun.

yeah maybe he should have thought about it as he was committing the felony. I don't give a fuck why he had the gun.
