so if its legal and you have your card
you take test and show positive, isn't that discrimination if they use it against you?
I know people (heroin addicts) who use a doctors note to get around this even at probation
shouldn't it be the same with reefer?
how does this work?
has anyone sued yet over this?
is there case law?
I'm talking about a desk job, where your not a risk to anyone
feel free to share...

Employers typically are able to, depending on the State I guess, discriminate for any reason, with the exception of age, race, sexual orientation, disability etc. Since marijuana is federally against the law, they have no obligation to hire anyone who fails a drug test. No court would even take the case, sorry to say.

I'm a legal cardholder, in a MMJ State, and quit a while back to get a job, because I'm an insurance agent and know this stuff. Sorry, get cleaned up or find a way to fake the test!

disability, thats right
thats what the law legalizing use is intended for, to help people with disabilities
you go to the doctor, tell him your disability, he prescribes medication
they dont test for prozac, it's discriminatory
State law says no discrimination for disability,
State law says ok to medicate
that says to me at a state level you can't discriminate for medicating a disability
Federal court does not have jurisdiction here, state supreme made the laws
 
business's are private and can set their rules as they see fit and they can make the drug test to not accept marijuana. Michigan makes that providing in the law and the ACLU wont try it in the court as they know they will lose.
Why not stop smoking for a month, take your test and get the job?
