What the Supreme Court ruled on was, according to Trump's lawyers, "why" they asked the question, not that the question was actually asked.
So what they're doing now is trying to come up with some new argument as a legal reason to ask the question. Trump is, as we speak, considering using an executive order to put the question on the census anyway and then have his lawyers argue that there's a different reason for asking it this time.
So, it breaks down like this in a layman's example:
You: Can I sleep with your wife?
Me: Hell no! What the hell is the matter with you?!
You: Well, I'm going to sleep with your wife because mine refuses to sleep with me.
Me: WTF?!?!
