Busted in the car, Justice?

So just a couple hours ago i was chillin in a large school parking lot where me and my friends usually blaze. After rolling 2 blunts (did not smoke them) we saw a cop car parked to our right, staring right at us. So we decide we're going to leave but before we can, the cop comes behind my car and approaches my window. It does not smell like weed because we have yet to light a blunt and my friend is smoking a cigarette. The cop tells me he can search my car regardless because he says he saw me rolling a blunt. He also had a dog that he used. After admitting to him we had 2 blunts because he was going to search the car, he wrote me up and now I have a court date so I can pay the fine.

My question is, was the cop able to do this? Just search my car with his dog even if there wasn't reasonable cause besides him thinking my hands were in the motion of rolling a blunt?

key word is "thinking" he diddnt have probable cause but cops do what they want. i had a cop outside my car once same thing but he was actually watching me roll through the window when i got a knock on the window and saw a badge in my face. i knew i was fucked and at least i had the doors locked so i ate the joint and leftover weed that was in my lap right in front of him.Poof no evidence no arrest now i only carry enough that i can eat if need be and dont bag it i use small tins to carry around.

I had a similar "bust" about 10 years ago . . . thinking it was just gonna be a ticket.
Unfortunately, this state requires all ticketed pot users to take a costly drug/alcohol course, which I didn't and thus, live with a contempt warrant. F that crap.

i've been arrested 2 times for posession and both times it was $200 court costs plus a $200 contribution to war on drugs =$400 fine
the second time i tryed to be a smart ass and said if it a contribution it should be be voluntary andthe judge looked at me like he was gonna throw me off a bridge by my dick so i just shut up and payed the fine.

recently my friend got arrested just walking down the street they stopped and searched his bag and found a gram of weed. he got a $400 fine and 20hrs of community service i dont think that is nessisary

Dude... whatever happens stop smoking at or around schools. I believe the penalties are much higher if you are anywhere near a school. I think they like to claim you are going to sell weed to the kiddies. Stay away from the schools man.... and good luck to you :)

Um, I know it's a little late to be asking this sort of question, but chances are there could be a next time, so here goes. Why on earth did you and your friend select a SCHOOL parking lot in which to blaze?

My suggestion for next time you want to burn one on the road: Fast food places that have a back parking area, or, park closest to the entrance.

For more specific legal information state and county are helpful. However, I wouldn't put that up here openly, this joint gets plenty of Google hits. I'd hit NORML.

Yeah, but you need solutions now and prevention for the future. Thusly my suggestion for future locations (high traffic, not unusual for people to be sitting in their cars just chilling, much more difficult for police to be selective about you). Seriously. I'm able to sit in front of my scoot and burn, right in front of everyone, because I know how to keep it on the down low and look like I'm just chilling out, having a drink and resting. The only people who bother me want to talk about my bike.

And going to NORML. Also, to help find state's laws regarding the ticket you got (it was a ticket, right?) it should have a statute # on it, Google that. They can't just write you up for something that they made up, the officer should have cited the statute number violation(s). Then, see if you can find a lawyer who'll give a free consultation IF your state's laws are such that you think you might need legal help.

just shows all the information he took from my license and wrote it on here (hair color, height, etc...). Then it says I will appear in court on *this date* and if I don't I will have a warrant.

what state is this in differnt states and countys arent hard on these cases in some places some are horrible hopefully when u go to court doesnt say its on school ground

No citation numbers or anything like that? He's got to say what you're being charged with.

a friend of mine ate his weed rather than being busted the cop got pissed and he wound up charged with obstruction of justice [felony] instead of a misdemeanor
