Dist. Atty. Steve Cooley said today he will prosecute dispensaries that sell medical marijuana even if the Los Angeles City Council adopts an ordinance that does not ban such sales.

On Monday, two council committees rejected the city attorney’s advice and changed a provision in the proposed ordinance, allowing cash transactions as long as they comply with state law.

“Undermining those laws via their ordinance powers is counterproductive, and, quite frankly, we’re ignoring them. They are absolutely so irrelevant it’s not funny,” Cooley said.

Cooley said state law and state court decisions have made it clear that collectives cannot sell marijuana at dispensaries.

He reiterated his view that most, if not all, dispensaries in the county are in violation of the law. “We don’t know of one that’s not engaging in just over-the-counter sales,” he said.

The district attorney said his office was already prosecuting some dispensaries, and he promised to step up efforts next month. Cooley said he decided to weigh in today because he was irritated that the council had ignored the advice of the city attorney, Carmen Trutanich.

“What the City Council is doing is beyond meaningless and irrelevant,” he said.

The district attorney’s view could complicate the City Council’s deliberations. The council is scheduled to consider the ordinance Wednesday, more than four years after it first began to study the issue of dispensaries.

“These guys over there, God love them, are four years into this, and they won’t listen to their good lawyer,” Cooley said. “They’re sort of doing their own thing.”

What an asshole! I am sure the streets of L.A will be much safer for this public servant's hard work picking on sick people.

I got up at the city council meeting yesterday and basically called the city attorney a media whore. I think it may be on the news. What a zoo it was yesterday!

OMFG! What a cluster fuck! Just because you're on the City Council even in the great city of Los Angeles doesn't mean you're smart. This will not be resolved this year in my opinion. I reserved my right to speak for the next meeting. I was basically speechless.

LA, you need to show up tomorrow. Things are getting out of control. The LA City Council voted today to cap the dispensaries in LA today to 70 but they were going to grandfather/give preferential treatment to the original 186. What? It will be more like 139 or maybe below 70. OK, that sounds good.

They also decided that they would not be able to "abut" a residential area. Oh, wait, let's make that 1000 feet. No that's crazy. There would be no dispensaries that would qualify. You're right. That is crazy. But.... It has to be "abut". No we don't like that word. What would you like to call it? I don't know. Let's debate it for 2 hours. Ok, let's make it 500. What happened to "abut". Oh that's right. Let's do "abut". Ok, so what's a residential area? I know this sounds crazy, but could that be where a homeless person decided to make their home. Oh, why, you're correct. It could. It could also be a motor home. Ok, that makes sense. So, let's make it 1000 feet from any residential area. Ok. Passed.

This is a sample of the 7 hour craziness that we endured today. We need your help tomorrow at city hall at 10PM. PM me if you can make it.

Today was a short day but an important one. The City Council went home last night and apparently slept off their confusion from yesterday. At least some of it. We showed up in force with some of the major players and they continue the vote until January 12, 2010. That will give them enough time to hopefully think this through a bit more. I was prepared with a speech that would have embarrassed the council and entertained the audience and cameras. I was so ready to give it. :( But it's all good since we got some breathing room!

Choose one or all of these topics to frame your comments:
1. It is not necessary to have a cap on the number of regulated medical cannabis collectives in Los Angeles. But if we must have a cap, it should be high enough to meet the needs of patients in the city. Based on current demand for safe access, seventy collectives are not enough. (Section 45.19.6.2.B)
2. Even LAPD Chief Charlie Beck agrees that collectives are not magnets for crime. Requiring collectives to be located 1,000 feet from a laundry list of sensitive uses and any residential property will make it impossible to find a location suitable for patients. Let collectives locate in regular commercial zones, just like pharmacies and doctor’s offices, without restrictions on residential uses. (Section 45.19.6.3.A2)
3. Patients may need to visit more than one collective to find the right medicine at a reimbursement cost that works for their budget. The ordinance should not limit them to membership in only one collective – especially since state law already limits how much medicine a patient can have. (Section 45.19.6.3.B15)
4. State law does not require every member of a collective to grow medicine at the same place. The City Council should change the definition of a collective to exclude the phrase “at a particular location.” (Section 45.19.6.1.B)
5. Patients’ privacy must be protected. The draft requires that the name and address of patients who receive medicine be recorded in records subject to inspection. This is unnecessary and must be removed. Strike subsection 8 from Section 45.19.6.4.

men suck! And now as I'm going bigger and meeting people in the biz that are huge, I'm finding that it's mostly shady men. Maybe I don't want someone in the biz but just someone that appreciates it.....a lot
