Why can't a grower protect his seed stock like corn?

[h=1]Chinese man arrested for conspiring to steal from Iowa seed corn company[/h]DES MOINES – United States Attorney Nicholas A. Klinefeldt announced the arrest of Mo Hailong, also known as Robert Mo, for conspiracy to steal trade secrets. The criminal complaint alleges that from on or about September 2011 to on or about October 2012, Mo Hailong and other individuals conspired to steal the trade secrets of several U.S. based seed manufacturing companies and transport those trade secrets to China for the benefit of their China-based seed company.
Mo Hailong is a Chinese national who became a Lawful Permanent Resident (LPR) in the United States pursuant to an H-1B visa. Mo Hailong is employed as the director of International Business of the Beijing Dabeinong Technology Group Company, which is part of DBN Group. DBN Group is believed to be a Chinese conglomerate with a corn seed subsidiary company, Kings Nower Seed.
During the course of the conspiracy, Mo Hailong and others are alleged to have stolen valuable inbred corn seed from production fields in Iowa and Illinois. This “inbred” or “parent” line of seed constitutes valuable intellectual property of a seed producer. After stealing the inbred corn seed, the conspirators attempted to covertly transfer the inbred corn seed to China.
The investigation was initiated when Dupont Pioneer security staff detected suspicious activity and alerted the Federal Bureau of Investigation (FBI). Dupont Pioneer, Monsanto, and their staff have been fully cooperative throughout the investigation, which is being led by the FBI.
In accordance with the Iowa Rules of Professional Conduct, the public is reminded that a criminal complaint constitutes facts supporting probable cause and that the defendant is presumed innocent until and unless proven guilty.

prolly more likely chinese guy had a veg garden with 3 corn plants in it on a one million dollar property near a Monsanto field. Local Monsanto rep likes said chinese mans house. Tresspasses and steals some ears of sweet corn. Tests show monsanto/pioneer GMO genetics cross pollinated man's sweet corn. They take him to court to steall all his property. That would be a more likely rendition of the story.

Ya, I think this is probably GMO corn. Just think, if we are able to genetically modify our cannabis seed for say disease or drought resistance we can patent the strain seed. The previous poster is probably right, when Monsanto and Pioneer get in the game it should probably be expected. However that doesn't mean growers have to buy or use your seed.

Corn is a legal cash crop world wide and in the US it can be patented as so. Marijuana a no legal cash crop in the US is not recognized by the fda so it does not qualify for US copyright or trade patent. Now if you live in a country where it can be patented due to legal allowance then good to go but not all countries will recognize it. Most recognize US patents as they will try to sell it in the US. This guy tried to steal it from the US where it was patent trade protected but China doesnt recognize our patents so once it would have gotten over there he could have had the Chineese gove handle its trade rights but it could not be shipped to the US.

Thanks for your insight. I thought only GMO corn could be patented. If that's the case pot seed may be able to be patent protected when and if it's ever a legal cash crop.

Here's a pm I received that I found very interesting and thought I'd share it, ---> It has to b a clone or S1 it cant have been in circulation for >year to z public and cant b a F1(Durban/OG) since thats something that can b reproduced without any real knowledge of breeding. Then it has to not b restricted by any other statue ie federal law
ppl who think they have a true breeding pheno thats currently being distributed publicly for >year prior to federal legalization doesnt have a chance in the patent realm. My suggestion would be to breed true for phenos and keep z genetics tucked away utilizing the bud for competitions etc never releasing seed/clone until the feds legalize it for example MapleLeaf,Skunk,OG stuff are not going to be able to be patented unless unreleased clone/sX

It would b interesting is a true breeding program using protoplast fusion to add terpenes to cannabis genetic profile from other sources or possibly utilizing a bacteria.
