I can understand where OP is coming from. I did not read this whole thread but from what I'm guessing OP had a good girl he really liked or maybe even loved. Said girl ended up not feeling the same way back and/or cheated on him or broke it off and was with another guy very soon after aka thinking about cheating and then doing it. Said dude is mad because he really liked her and now as a way to get back at her he wants to do some shit that may hurt her reputation. Believe me, I understand how a woman can be conniving and really hurt someone, but I also see men do it as well everyday, its called human nature, we are all some evil mother fuckers in the end. Remember this, your head is an animal...that is all...and so is hers and that will never change...like someone else said, be the bigger man...walk away. some day you will look back and shake dudes hand for doing YOU a favor. and when that day comes, your going to feel alot better about yourself when you realized you could be mature about the situation and handled it right...good luck

So there you have it. Blackmail is not really a crime in and of itself. It requires that you be violating some other law in the process. As far as I know there is nothing illegal about posting pictures of yourself with a former lover on the internet, provided they are aware of and consented to the pictures in the first place.

The more I read this and think about it...i'm not so sure. It makes it sound like the act of blackmail itself is a crime. I can't figure out why they put the phrase "against any violation of any law of the United States" inside the actual subsection though. WTF does that specify or clarify in the statement?

What if I threaten to tell my girlfriends husband that she has been cheating on him with me? That is perfectly legal.

What if I ask my girlfriend for money? That is perfectly legal.

What if I threaten to tell her husband about the affair unless she pays me money? ...Is that legal?

And i'm not going into detail ..but she deserves a little humble pie. Any not so saintly thoughts on how i could fuck with her using these pictures? Other then sending them to her parents lol.

The more I look into it most states have specific laws on the books for blackmail/extortion. I can't quite wrap my head around it all. I know blackmail should be frowned upon, and in a general sense I think it may be a good thing that it is so frowned upon that we have laws against it. But at the same time I can't quite figure out the legal justification. What exactly justifies making it illegal?

If I catch someone cheating on their spouse I can freely tell anyone I want. I can use that information to destroy that persons personal life, and possibly their marriage and family, and it's all perfectly legal. If they know that I know they can offer some "hush money" to me which is also legal. But if I use that information to demand money, or something else of value, in return for my silence, then THAT is blackmail. The use of the information as leverage against the person.

I don't understand why you can perform the EXACT same actions in a contract negotiation and it is perfectly legal though. Or how courts can enforce non-disclosure agreements. I literally cannot comprehend the difference that makes blackmail illegal while those other actions are perfectly legal.

Also, did the op attempt to get any money or anything in return? If he is just threatening to post pictures to be an asshole then it is not blackmail. Just like I could threaten to expose a cheater, and follow through on it. As long as there is no demand for compensation there is no blackmail.
