Need advice. Got arrested and suspended from school for dime bags with no res.

So here goes the story. Im in high school and yes i am 18. My teacher reported me smelling like weed. I got called down to the office. They searched me. Upon search they found about 15 dime bags. THE BAGS WERE EMPTY. NO WEED RESIDUE. They were bought from 7-11. The cop wasnt conducting the search. The administrator was. As soon as the admin pulled those out my bookbag the office started screaming at me right away. He told me i would be charged with drug paraphenalia. I told him i dont use them for drugs. He said shutup or this will get worse. I figured arguing with the cop wouldnt do much. When the cop left the room for a minute to write up the paper work i asked the admin what was happening school system wise. He told me im not getting or suspended or anything. Im just involved with the cops. When my mom came in the office he was telling me how im suspended for 10 days due to drug paraphenalia+charged by the cops. Anyways can i overturn the suspension? Can i sue the school for money?-im not all about the money. But it is horrible that i got suspended for ziploc baggies. It put so much stress on me and my parents. My gpa will be hurting now.
Will the court case be dismissed?

baggies are not illegal unless there is residue. No residue no charges. The cops should have ignored it all together. Sounds like a bunch of crap to me.

are you being charged with a crime? If so than obv just fight it in court you have nothing to worry about IMO. If not than you need to get your parents involved and possibly a family lawyer if you have one to talk to the school and tell them you have a good reason to have them they were purchased like that (probably not individual purchases) and threaten them because you can't miss school because of a technicality it's not fair to you or your educational opportunity. Something like this could go in some kind of file inhibiting your future success.

GEt a lawyer. A Lawyer may be able to turn it in ur favor, not to mention answer all your questions. Sounds like the school wrongly searched through your bags. They dont have the right to touch you or your stuff as far as i know. Wont hold up in court, but make sure the school/cop pays for what they did to your "image". Once you admit to anything it puts u in the wrong. DENY all. Next time, ask for a lawyer b4 you say anything else. Silent treatment is ur right, and they can make all the empty threats they want (scare tactics). And they didnt even find anything. Sue them for slander. GET A LAWYER.

Lawyer up quickly. They can't suspend you for baggies with no residue unless you had other items on you. They are your medicine bags for all they know. The smell can be easily played off as something else and smell by an untrained teacher won't stand for anything.

alot depend on your state concerning drug laws in school zoning area along with laws concerning with minor under the age of 18. although you said you are 18 years old and still in high school, that is to be determine by the judge if any charges will stand as a minor or adult! given the limited info you gave, i don't think you want to make a big fuzz over something that could've been worst. Ya, your GPA is going to hurt a little and other kids will know more about the incident. Dust yourself off and learn from your mistakes and become a smarter student (inside and outside of class).

that question about if weed had ever been in the bag is gonna be a sticking point for sure.. if there never was i don't see how you could lose.. if you had a lighter on you, would they have charged you with paraphenalia as well? this is crazy.. best of luck to you, and i agree, lawyer up with a quickness..

get yourself a lawyer and get ready to sue the city (police department + school) for defamation of character, slander, and harrassment, anything else you can think of!!

claim extreme emotional distress, you can't sleep at night, now you have a phobia of police officers you did not have before.... go all out.

that should make those cops and that principal think twice before going through an innocent kid's bag.....

I'm not defending it. It's rampant in public education.

Zero Tolerance gives educators and administrators cover by taking away their discretion.
 
Unfortunately schools are aloud to search students based on reasonable suspicion, which is different from the way cops search, probable cause, this was decided in the supreme court case Nj v TLO. The search was completely legal but, for an empty bag there must have been some residue to cause a smell.

yupp gotta go with Johnnyorganic on this one, in school because of the zero tolerance policys there isnt much you can do other than try to talk with the officers and get them to let it go, the school system is pretty ridiculous now but it is what it is.

i bet 100 seeds u didnt even get a record with local police just at school

u r guilty and will be treated acordingly. u should never talk to the cops.if youve been charged youll go to court and your public defender wont do shit.... so hire a lawyer. dont be such a dummy 15 empty dime bags ......you fucked up by not leaving school as soon as they sent you to the office.

Zero Tolerance means zero tolerance... when i was in hs, me and my best friend had a habit of 'pantsing' (yanking the pants down)each other in gym, it started out as a harmless prank, then turned into a flat out war, lol. but to make a long story short, we both like to got expelled for sexual harrasment one day, because there was a substitute teacher that wasnt hip to our little war (the reg gym teacher didnt give a shit as long as we wernt causing trbl for him) even though it was a prank between friends with no hard feelings, we both had to testify and practically beg in front of the school board to be able to graduate. Lawyers were brought into the mix, because the school system had a zero tolerance policy for anything even closely relating to sex harrasment or hazing. Eventually (at the suggestion of our principle) the school board agreed to a 15 day suspension on top of 21 days of in house suspension, and then only becasue lawyers were there. if the lawyers wernt there, i prolly wouldnt have graduated.
so my advice to you, is call a lawyer and get some kneepads, because your about to go through some serious ass kissing if you want to graduate with your class.... whether or not there was any product in the bag is irrelevant, in fact, you should have been arrested on paraphanelia charges in most cases, and since your in a school zone, consider yourself extremely lucky you dont get charged with felony distributing as well.

ps- that whole incident with me and bud happened 20 years ago, when laws were alot more relaxed than they are now......

Gotta listen to people who have been there. there isn't a case. it happens all most everyday at every high school all the time. (exaggerating) but really.. some of us know people in the education system or are part of it. You guys are kids and although you deserve the same rights as any adult. You don't have them by law. and 15 emptys??? cmon' man. just learn from your mistake. we've all done shit like this. I got busted with a dime bag that had about .1 gram in it after i called 911 for myself. the cops cuffed me while bleeding like a pig as if that's what cut me. They showed no mercy and i was an adult. You'll make it through this bro. GET A GOOD LAWYER. and TRY EVERYTHING to not get a felony charge.
