Basic outline of OCTA will allow people 21+ to purchase cannabis in state stores or grow it for themselves. It does not allow people to grow and privately sell the cannabis, which is a crime. Taking cannabis out of the state for sale in another state is a crime. Giving cannabis to minors or selling to minors is a crime. Driving under the influence is a crime. The good thing about OCTA is that it is NOT attached to the OMMA in any way so in the event there is federal overturn, people who are cardholders are unaffected. The Attorney General also has to defend anyone under federal prosecution within OCTA guidelines or federal challenge to OCTA.

Pretty much, OCTA treats cannabis as alcohol. We can brew our own beer at home, can use it on our own, but cannot sell it for profit or give it to minors for consumption. We can't drive under the influence, etc... However, I just won't toss a plant outside to grow because I can if OCTA passes. People are still going to target others and rip people off, but it will be nice to see cannabis treated differently. Ultimately it needs to be descheduled at a federal level or put into schedule 4 at the very most, preferably a 5 if it were to remain scheduled. I think that if more states start to push to legalize cannabis or make it available for taxed sale, we might see the feds relax as well.

Spice is 15 times more powerful than marijuana when smoked and doesn't show up on a drug test. Drug sniffing dogs can't detect it. And most police departments have never even heard of it.

That's a step back. It needs to get scheduled like North Carolina.

90‑94. Schedule VI controlled substances. This schedule includes the controlled substances listed or to be listed by whatever official name, common or usual name, chemical name, or trade name designated. In determining that such substance comes within this schedule, the Commission shall find: no currently accepted medical use in the United States, or a relatively low potential for abuse in terms of risk to public health and potential to produce psychic or physiological dependence liability based upon present medical knowledge, or a need for further and continuing study to develop scientific evidence of its pharmacological effects.
The following controlled substances are included in this schedule:
(1) Marijuana.
(2) Tetrahydrocannabinols. (1971, c. 919, s. 1; 1973, c. 476, s. 128; c. 1358, s. 15; 1977, c. 667, s. 3; 1981, c. 51, s. 9; 1997‑456, s. 27.)

EUGENE, Ore. -- In November, Oregon voters will make a decision about medical marijuana dispensaries.
KVAL News wants you to make an informed decision about Initiative 28, which would allow state-run dispensaries to sell marijuana.
Under current Oregon law, patients with certain medical conditions can have, grow and use marijuana for therapy. However, patients must either grow the pot themselves or have someone else grow it for them. They cannot buy it.
So, what exacatly is medical Marijuana anyway?
In the state of Oregon, patients with debilitating conditions can apply to the state department of public health to use marijuana to ease their conditions.
Thousands of card-carrying patients right here in Lane County use medical marijuana to treat debilitating conditions.

By state law, doctors can recommend marijuana use for these ailments: Cancer, glaucoma, HIV/AIDS, severe pain, severe muscle spasms, seizures and Cachexia, and some conditions brought on my Alzheimers. The majority of patients -- 65 percent -- use it for pain.
How do patients get medical marijuana?
A patient must fill out an application to the state department of public health. That application must be signed by a state-licensed doctor indicating that they believe marijuana use could help the patient's condition.
If approved, the patient can receive a medical marijuana card and is thereby allowed to legally use it as therapy.
How many people have the card?
As of July 1, 2010, there are more than 36,000 card carriers in Oregon. There are about 4,000 in Lane County.
Last year, the Oregon Medical Marijuana Program received about 24,000 applications. About 1,000 people were denied.
Who can grow medical marijuana?
Under current law, a card carrying patient can either grow pot themselves or designate someone else to grow it for them.
Either way the grower and grow site must be indicated on the application.
Once a grower is designated, they must have a medical marijuana grower's card. They also may not have more than six mature plants at a time.
Between a grower, patient and/or primary caregiver there must not be more than 24 ounces of useable marijuana between them.
That's about the size of four softballs.
Right now there can be no exchange of money between a grower and a patient, but Initiative 28 could change all that and allow for dispensaries to sell the pot.
Many patients say the current setup doesn't work and that it can make them feel like criminals.
Watch KVAL News on Thursday, July 22, to hear a medical marijuana patient talk about how dispensaries would help. On Friday, KVAL News will look at how law enforcement feels about the possibility of dispensaries.

ALOHA, Ore. (AP) — Three people were arrested at the home of a registered Oregon medical marijuana patient and caregiver after a search turned up more than 100 plants and nearly 4 pounds of marijuana.

Detectives from the Westside Interagency Narcotics Team served a search warrant Wednesday in the Portland suburb of Aloha after a tip that marijuana was being grown and sold at the residence.
Arrested were 49-year-old Melanie Ann Orr, her daughter, 20-year-old Amanda Dawn Orr, and 45-year-old Michael Eugene King. All were charged with manufacture, distribution and possession of a controlled substance.

Police said Melanie Orr is a registered medical marijuana patient and King is a registered caregiver.

A 9mm semiautomatic pistol and a 12-gauge shotgun were also seized with the marijuana.

EUGENE, Ore. - Oregon voters will decide in November if the state should have dispensaries to sell medical marijuana.
Supporters of the idea gathered enough signatures to put the issue on the November ballot.
Alice Ivany, who lives near Newport, was one of the chief petitioners for the initiative. She said marijuana has totally improved the quality of her life. "It works for pain like no other medication out there," she said.
It will be up to voters to decide if Oregon's medical marijuana act should be expanded. Ivany said the original law in Oregon didn't go far enough.
"As wonderful as the original act is, it still was fatally flawed in that it did not allow safe, legal access for patients to obtain medical cannabis," she said.
She believes a regulated medical marijuana supply, sold in dispensaries, will be much safer for Oregonians. "Not only are you exposed to dangerous people but you don't know exactly what you're getting," she said. "The medicine could be tainted with other drugs."
Oregonians right now are required to grow their own marijuana or have to find someone to do it for them. They are also limited to 6 mature plants and 24 ounces of marijuana. If voters approve the ballot measure in November, patients could buy their pot at a dispensary or continue to grow their own - as long as they have a license.
The new law would allow dispensaries to have 24 plants and 96 ounces of marijuana, and the state would regulate sales. The dispensaries could not be located within 1,000 feet of a school or in a residential area.
If voters say no, the state's medical marijuana law will stay as it is. This is not the first time the issue has been up for a vote in Oregon. Voters rejected a measure to set up dispensaries back in 2004.
KVAL News talked to foes of the measure. Hear why they oppose dispensaries on KVAL 13 TV News Friday night and on KVAL.com.

I am so sad 74 didn't pass...$1000 and anyone can be a producer, regardless of medicinal status. That would have been so cool. And only $2000 for a dispensary license! That could have created so much income potential for so many hurting people.

Honestly, OMMP as it is kinda sucks. It is extremely hard to get qualified unless you are terminal or have serious chronic pain. I am a pretty young and healthy guy but I have tourrets syndrome that causes me to twitch my eyes and head and sometimes other parts of my body uncontrollably if I don't smoke, which can cause headaches and muscle pains. And yet I do not qualify under OMMP. I called a clinic and they confirmed this. A doctor's recommendation should be all that is required. It should not be up to the state to say who needs medicine. I think that's bullshit. I love living in Oregon, but the weed laws suck balls.

some of the OMMP rules are retarded and it is getting harder to get only cuz people who really dont need it found ways to get it, but at least it is legal to patients, its better then not being a medical state. that sucks you cant get your card. if i were you i would start seeing a doctor about the pain you get instead of the tourets and twitching you might have and although you will get it for your pain it will really be for what you have.
does weed help you with your condition? the most bull shit law i think their is for OMMp is that your aloud 6 mature plants but yet can only have a pound and a half of dry material when 6 plants can easily get you10 if done right. and another one is that when you dry a plant and cut each branch off to dry and then hang all those branchs are now considered 1 plant each and if caught your in trouble. like lets say i have 1 plant that has 50 branches i hang to dry and they see i have those well now that is 50 plants and i am 44 over the limit.

Never heard of that before...I guess cut the buds and dry em on a screen lol...

Ya when I was a kid people teased me a lot for my conditions...as soon as I found weed for it though people are generally shocked to hear I have it...I tried probably half a dozen or more rx drugs as well and none of them did a Damn thing. I only need to smoke once a day or so as well. I don't toke all day til I get off work at like 9pm and yet it is still enough to keep me on the level.

So ya, I'm glad patients can get access if it is life and death but I wish access for the rest of us made more sense. In California all I had to do was call a 1800 number, give them my med records and they hooked me up.

it is right in the packet the clinic gives you about the laws, i still cut them into branches cuz they shouldnt have a reason to check. and ya you can cut the buds off and dry on screens or just dry the plant as a whole
