Has anyone been through a federal court sentencing etc for weed. My uncle has his sentencing coming up in a few days and was wondering is there any main points I should state or not state etc. quick background he was busted beginning of last year with almost 1900 plants 65lbs etc he was locked up paid a hefty chunk was out the next day we'll the feds came to his house in middle of year last year and he had just germinated like 18 babies still in solo cups. They re arrested him and has been incarcerated since almost a year. is there any main points to say or shy from thanks

Ya i dont think much of what he says or doesnt say is going to matter very much.
Its not like he can say "1900??? That makes no sense i only planted 5 they must have reproduced 1895 times."
I hope you guys put aside alot of money for a good lawyer that can find a loop hole or fuck up somewhere or he is fucked.

Sorry man its a shitty situation.

I've always wondered how other MJ cases fared when bringing up this gem. Does anyone know how they argue against this in court, and the fact that they grow cannabis themselves as medicine for a few select patients? How can they state that there's no medicinal value?

the Us gov patent presented should hold up. Its proof that they can't charge you with the crime of schedule 1 narcotic.

According to the feds cannabis has no medicinal value. The fed patents say they do, so all they need is education. They have no choice but to downgrade the charges after seeing the medical benefits. Your uncle might get a schedule 2 if you use this defense.

Besdides if you read the post again hes already been found guilty and awaiting sentencing.

He has grown for 30+ years ND never in troublr. He got into a car wreck flipped into a ditch and stuck for 24 hours in the ditch after that he has been not himself in the head. After the wreck he started blabbING and got busted by a confidential informant. I almost want to say he's Mentally fucked in the head

Meth is schedule 2 and them dudes get a good 20 years I'd have left the country after the first bust guy will probably die in federal prison depending how old he is.

Did you bring up the mental incompetency with an attorney? He needs to get a diagnosis for his behavior. If you can get his poor decision making and impulsiveness tied to an actual diagnosis you might stand a chance. But this would have been much easier prior to sentencing. Once you reached sentencing you enter the world of Federal Appeals. Good luck on this.

If I were him, i'd go.
Course who made the bail for him?... They'd be fucked...
