Regardless, still a felon is going to have to jump through the states hoops to ensure approval.
We cannot forget this is a state run program.

Most state offices require a full copy of the official police report, a personal explanation of the crime(s) as well as multiple written recommendations. (fact)
AZDHS may not go to this extent but I would not put it passed them. (opinion)
If at any point they need to judge someones crime, they will obviously need the police report or some official account of the incident. (fact)

I have personally been previously employed by the state of AZ.
No, I do not have a record; but I have seen my peers get shot down at a lowly Real Estate agent license approval for a misdemeanor crime. (fact)

IMO:
If the actions of the state, leading up to this point in time, are any indication of what the future holds, the state wants to make it tough for cultivation.
If they cannot stop dispensaries, I foreshadow the next step will be to make the employee approval process very tough. ESP. for the growers.

This is also a right to work state. So I guess, in theory, if a grower is denied a position due to a previous conviction they could spend their money suing the state under this clause.

A dispensary agent cannot have been convicted of an excluded felony offense. An excluded felony offense means:
  • A violent crime as defined in ARS § 13-901.03 that was classified as a felony in the jurisdiction where the person was convicted
  • A violation of a State or Federal controlled substance law that was classified as a felony in the jurisdiction where the person was convicted, but excluding
    • An offense for which the sentence was completed 10 or more years prior
    • An offense involving conduct that would have been legal under the Arizona Medical Marijuana Law.

Still requires a review and offenses that violate AMMA are extremely broad.
Selling marijuana violates AMMA.
Possesion of a certain amount is also illegal under AMMA.

Its not going to be a walk in the park for a felon, not fair IMO, but typically that is how it goes in the business world..
I do not think dispensary owner would give two shits felon or not..

Similar situation: there are felony conviction restrictions for AZ caregivers.
Reason being, they do not want criminals growing product.
Double edged sword kinda as im sure in many states lots of good growers have some sort of conviction.
A good way to test the waters might be to try and become a caregiver and see what AZDHS says.?.?

The fact is we are not the ones who have the final say in the approval, AZDHS is...
I personally do not know what they are going to require of felon applicants to submit for processing, but I do not doubt some paperwork will be necessary.
Nobody will ever really know the outcome until someone applies and is turned away for their offense.

For those who are not starring down the barrel of that gun, knock on wood...
Our officials are fucking sneaky.

DUDE that lady was CREEPY!!!! and the husband just didnt seem to care one way or teh other...haha. Odd doc for sure!

I just renewed my AZDHS MM card even though my original card doesn't expire until the end of September. My understand (from reading on the AZDHS website) is: If there is a Dispensary OPERATING within 25 miles when you RENEW your card, your lose your rights to cultivate. They won't be looking up patients that have existing cards and asking for a "redo."

Also, I was surprised to see that even though I renewed the first week in August, the RENEWAL Card doesn't become effective until my original card expires at the end of September. My renewal card keeps the original expiration date. So even if someone opened a Dispensary next door tomorrow, I can still cultivate. Again, the right to cultivate is determined when you RENEW, not after you get your card.
Any idea how far out you can "early renew" your mmj card? Would 10 months be too far in advance? lmao
