its only entrapment if their is a crime. As long as the Pt was in Compliance with their limits, they are legal, thus no crime is present.
so its a double edge for the cops and law enformcement really. shame on them.
if they are falsifying information, to illegallly obtain MMJ cards, they are breaking the law! plain and simple.
if they are Making their own fake MMJ cards, the are breaking the law plain and simple.
if they are then using these fake, or illegally gotten card to make a pt to pt transfer they are breaking the law.
now, heres where it may get sticky. if when making a pt to pt, they find the donator of the meds, is out of compliance with the law, ie, has 5 oz on hand, when 2.5 is the limit as this perticular pt is his own cg, and has NO assigned Pts. thus being over the limit, the dontator of meds is ILLEGAL, thus the cop can do his, and i use this term EXTREMELY LOOSELY, "Duty".
but even then, it would be illegal in 2 ways if said officer was "On Duty". one, he would be perfroming and entrapment scenario, or waisting public tax dollars if he just happened to stop by, to get some med for his personal off duty use.
2ndly, Local Municipalities in the STATE of Michigan, need to remember, they are IN THE STATE OF MICHIGAN, So STATE LAWS APPLY TO THEM as well, as EVERY OTHER COUNTY in the State.
State Employed Judges, PAs and other governmental authoratative posistions, such as the AT, need to remember, THEY WORK FOR THE STATE OF MICHIGAN, NOT THE United Stated Federal Government. Michigan is a WILLING Part of the US Fed Government, So State Laws Trump Federal Laws, which is how our founding fathers fully intended FEDERAL Government to be.
