Again, that is exactly what happened.

The driver displayed signs of being impaired. They arrested him and had him tested. He tested positive for marijuana and was immediately charged.

Now, are you going to tell me that if he tested positive for methamphetamine instead of marijuana they would have let him go?

Or alcohol?

Or PCP?

Seriously? That's what you're saying?
If you're under 0.08BAC you are deemed not impaired DESPITE having alcohol in your system. If you're under 5 nanograms per deciliter of THC you are in the clear according to CANADIAN law. Are you too dumb or just ignorant to see how your statement of ANY narcotics in your system equates to an arrest automatically doesn't apply here nor is it factually correct. This is a DIFFERENT country. Thats ALL I had stated from the get go. I guess that was too complicated for you to understand after explaining it TWICE.

Stay in your lane next time you try to educate others on the laws in THEIR countries. LOL fucken clown. Sounds like one of those touchy feely progressive Democrats .

PS that little part about it being up to medical patients to be sure they aren't impaired was cute. What might impair you may not impair another and vice versa.

Let me see if I have this right..........two Americans are trying to tell me the ways of the world when it comes to Medical Marijuana in Canada. On a site for Canadian Patients. Am I missing something here ? Are you guys cops or what ? Thanks for the laughs.
What relation does this specific case have to do with medical marijuana or Canadian patients?
I am not a cop, and dont need to be one to have an opinion on driving under the influence. You want to up the anti and accuse me of harassing the sick?
Id be willing to bet your opinions arent in line with what the majority of Canadians agree with. Unless sharing the road with the inebriated is a part of the fun up there.
Im sure you will argue that you know better, but wtf.

Im a regular blunt smoker.. I can smoke a blunt and hop in to the car and go to work.. I dont cross any road lines, dont txt and havent had a citation/accident in over a decade. With that said, I rarely smoke dabs but when I do I know I cant drive for a while afterward because I get intoxicated and could easily find myself in a similar situation as this guy.

Heavens forbid someone jumped in front of my car or I hit a biker who runs a stop sign or something because although Im not impaired when I smoke a blunt I know I would be considered being under the influence.. I think Im going to ride the bus more :dunce:

Sorry guys, you are wrong. This guy WILL go to jail, and deservedly so. He was high when he had an accident, he killed someone's mother? Wife? Daughter? Sibling? That shit is no joke, and this is not a "good case" to test out a constitutional challenge (although it will be used that way), this is a tragedy and whether or not he felt impaired, he crossed the line and someone died... while noticeably high.

As pot users we all know when we are impaired, or too impaired to drive. I believe that everyone's level of impairment is subjective, but with the law, someone's comfort level while being high is irrelevant. There will be a BAC the politicians and MADD will agree upon, and that will be the standard much like 0.08 for alcohol (Or 0.05 in Nova Scotia, as your car will be towed and your license will be suspended for 24 hrs. It's not a DUI, but it's close.). Your level of impairment at said BAC will be irrelevant much like alcohol.

I'm staunchly opposed to some bullshit "catch all" level of impairment that will punish medical/experienced users, but my opinion doesn't make a shit bit of difference when it comes to laws and lawmakers. This is fight that cannabis users are going to lose, because public perception is if you smoke pot and drive, you are impaired, and to a certain extent, it's true.

Hey, as a med guy, I'm always over any limit they set, at any given moment of any given day, but I'm going to be realistic about my expectations. If I kill someone while behind the wheel, I fully expect to go to jail, fair or not. He may not have been impaired, but if he shows a high concentration of thc in his system (which I don't know that he had, but the cops seem to think/know so), he will go to jail. End of story. The law doesn't care about fair or your opinion, that's why prisons are full of marijuana "criminals". Some deserve to be there, some don't. Fair isn't part of the equation, neither is your emotional response to whether or not you think you can drive high or not.
