Williamston, MI bans the use of Medical Marijuana

On the personal use or growing issues this ordinance will have no legal affect and would not hold up in court. They cannot nullify the act or create ordinances in conflict with state law. And guess what the MMJ Act IS STATE LAW.

I can ban chewing gum from my property but I don't think a judge is going to carry out the execution orders should someone choose to ignore my ban.

the fear of a judges decision to uphold is not the fear. the fact that the nazis would attempt to do this, and be supported by some is the real danger.

Don't be scared homie, how often has the fed demonstrated that they trump state law? Enough for me to see how well a city council can ban a state law. WTF is this some small town in the midwest where you can get arrested for dancing unless KEvin Bacon moves in and shake up your old school ways? it's not going to work but good luck city dicks!

Livonia has the ban already. I see a bunch of articles about them trying to repeal it but I don't think it was dismantled. On top of that looking at other medical states, these things are happening. Just avoid the areas and that's all you can do for the time being.

Im sure you guys have all heard of JAMS for probation. My hometown Judge actually owns part of it, so he sends someone to the program he gets a cut on top of all of the other judges forcing JAMS upon people. Its pretty cool.

I agree with that. My statement was a personal statement. I know exactly how the real law is completely ignored by the judges.

I believe that Williamston was the home to one of the first collectives that threw into the face of LEO that they were going to allow smoking in their club. I had a feeling people were going to be pissed enough to do something about it. It's a very conservative area.

Is this the town getting even, or more than that I wonder.

I was going to mention that but then forgot to. lol.
They has a medicating area on site and that was part of the justification for a raid.

thing is, NOTHING in the act precludes anyone from medication on private property or in a private group, So long as the property is private......
Now is it a good idea? no, of course not, but neither were speakeasys in the late 20s. Point is, medicating and where you can do it is only NOT allowed in particular scenarios, and they are Explicitly outlined in the 08 MMM Act.

and no county can impose laws that are MORE strict or Restrictive than the state laws in which that county resides.... This Township is Acting Illegally and Improperly, and Against the Will of the People plain and simple.

Look where does it end? Should the county outlaw birth control because the repubs and catholics think its bad for a woman to take? My daughter MUST take BC to regulate a hormonal imbalance. So should She be a Criminal due to a Medical Need? that is the Simple Basic Question and the answer is a Simple Basic NO.

On All Accounts.

Very much on point there Timmahh. All of these municipalities that are trying to outright ban medical marijuana are just going to cost their taxpayer base in those cities a shit ton of money dragging out a courtroom brawl that they can't win. As Timmahh mentioned above, municipal law cannot override a state statute and it's as simple as that.

But what about federal law? Doesn't federal law supersede state laws? If a municipality tries to abide by federal laws by passing an ordinance (like Livonia has done) how does that play out? Are they ignoring the state law, or just abiding by federal law?

The possibility to get fucked is ALWAYS there when you try to pick and choose laws. The mere fact that THEY don't even agree with each other just shows how fucked they are. Bravo for Livonia and these other haters to fess up and let everyone know before hand that they are a bunch of assholes. Looking up information in a prison law library sucks whether you are guilty or innocent.
