What to expect in court

OKay so SWIM lives in New Jersey and was with his buddies at a park and two of his buddies sparked a joint and soon enough a cop showed up. The cop searched everybody and found weed on 5 people including 18 grams and 4 empty dimebags on SWIM. SWIM is a minor and this is his first offense. SWIM wants to know what to expect in court and what charges will be pressed and the penalty.

Here he would get probation and have to do comunity service for possession but 18 grams is just over two ounces so with the extra baggies they might charge him with intent to deliver. Was the 18 grams in one bag or a lot of bags??????

N.J. sucks........I once did 60+ days jail time on a 180 day sentence for possession in a school zone- actually I was caught growing MANY plants in a building and it was "paid" down to a 3rd degree with numerous other charges dropped. I'm guessing he'll get a simple possession charge with 6 months probation, a mandatory drug class with piss testing, $500 fine with court costs. It all depends on the prosecutor and the judge you get assigned. Also depends on the county and circumstances around the bust as detailed by the arresting officer........

There are 28 grams in a oz so it's slightly over 1/2 oz... not 2 oz. Yes, 100 hours of community service is also probable.....

Haha, yeah I would have jumped on that if they hadnt lol Maybe alter your view of the 'greatest country in the world' by telling you that here in the UK youd get a slap on the wrist for 18g (unless your a minority ) - no community service or criminal record (you get 3 'cautions' before having a crim record)... not that this is the best country in the world by any stretch of the imagination.

Keep in mind that SWIM is a white rich kid that gets good grades etc and this is his 1st offense. If all of the weed was in one bag can they still charge SWIM with intent to distribute because of the other empty dimebags?

No, a good laywer would argue that off easy. But if there was even more than two, ie, three. It changes stuff. Now with that said what was he charged with. If he does not have charges he is either a rat or a lucky kid. If they hooked him up, took him downtown, he has charges. They dont release you after you are in without charges.

SWIM was taken to the station and had his parents called and information written down. SWIM was not handcuffed nor told his rights. SWIM was also not told he was being charged just that he would receive a letter with a court date.

Were the dime bags new/empty, or used/empty?? If they were new/empty then you'll have nearly no chance arguing against intent to sell.. If they were used/empty then a decent lawyer 'might' be able to keep things a matter of possession.. I don't know anything about NJ either way, but I'd rather be in your shoes than alot of others who post scenarios here..SWIY though has obviously not been afforded their right to a quick and speedy trial because given Rollitip's TOS this obviously must have occurred atleast 13 months ago..

Don't sweat it.. Americans in general aren't famous for their math skills, and you're from NJ ontop of that.. I watch the TV, and from what I've seen you must still be in the 99th percentile..Edit: My bad on mistaking this poster for the OP.. Now I'm mot just a dick, I'm a dick with a foot in my mouth..

They were both new and empty but according to my freind who was busted for having 10gs bagged out in a high school(he only got probation and kicked outta school) SWIM is likely to wind up just getting probation for a year with a small fine.

first offense, conditional discharge, no probitaion, nada... you should walk, but have to pay heavy fines..
make your one and only conditional discharge worth it though.. it sucks using it on something shitty..
