Simple possession, again, in South Carolina.

arrest took place on march 14th, at like 12am. After sitting in detention for 6 hours, the magistrate met with me and i signed a paper saying i wasn't going to have a court appointed attorney. At the time i was sleep deprived and had a negative high like a mofo, i just wanted to get out of there. So yesterday i was there and the judge left the court room before me and my dad got called up to the stand. So an officer started offering reductions to tickets, and said we could either wait for the judge, or talk to him. me and my dad spoke with the officer about my options. If i pleaded guilty, i would pay around 350$ and lose my license for 6 months, along with having that charge on my record. I actually asked him how i would benefit from a lawyer but all he said was "that's up for you to decide." lol. ALSO, at the time, i thought a jury would be good because maybe the jury folks would have souls, and see the unfairness being forced upon me and many alike. But you make a good point, a jury in a conservative state may be a bad idea. I don't think i'l get the letter on the new court date for a while, so is there still time to change the jury problem? Also, i'm getting into contact with a lawyer in Beaufort, SC, hopefully. He specializes in drug offenses and DUi's among a bunch of other stuff. Helps defend simple drug offenders like myself from "malicious penalties." So im praying this goes well, i have 3 other lawyers in SC besides him to choose from from NORML's site.

Make sure you get a lawyer. as to see how good the lawyers are ask to see their win loss ratio. I can tell you right now there will be no jury. You cannot afford it.

dude i got pulled on the 11th and had to sit at LCPD all fucking day.. but i only got caught with .5 so idk what they can do with that. They searched me and found my bong and stuff though with the dog even though he didnt have consent

Well if it was your first time getting busted, then you should be pretty good..and for only .5, it's stupid that they even bother. As far as searching without consent, that's bullshit. U sure they didnt smell it or anything? Or maybe u gave them consent without knowing, idk. If i ever get stopped again, whether i have herb on me or not, they arent searching my shit without a warrant.

Yea, dude was an ass, i was on my way to school and i get busted with less than half a g and they say theyre gonna give me 5 years.. lexington county is stupid as shit, theyre probably not gonna give me anything i just dont want it on my record or to go to pti for something that stupid. and no, i didnt give him consent, he said,"if i ask you for consent would you give it to me" and i said no and he searched with a dog

First off, you'll probably have a bench trial. In other words, no jury. The judge will act as the jury. Good luck trying to convince a judge that the law is wrong.

Second, do you think you are the first person to every try that? Ever seen the movie Blow? How well did it work for that guy?

The jury can make determinations about if you broke the ordinance/law or not. NOT if it's socially acceptable for the law to exist. That's for the legislators and the State Supreme Court to decide. If you want to argue it out for 10 years, paying hundreds of thousands of dollars to get it up to the supreme court, go for it. Otherwise, play the game buddy. Get a lawyer, post pone the shit out of it, get a reduced sentence and move on.

The legal system doesn't work like you think it does. You can't reason your way out of it. You can't argue the law. All you can argue is if you broke the law or not. You did. They have plenty of evidence for that.

I have a pretty good knowledge of the law even though I'm not an avid studier of it. I just was not sure on specifics with canine units, none the less that's not what I'm worried about.

I was stopped at the red light, it turned green and I drove thru it. Fecking crooked PIG. He pulled me over because I was white. I was with my wife and 2 kids and he was fecking nasty to me.

Here's a nice little story. Me and my friend were on our way to a spot and when we encountered a police checkpoint. We had just come over the hill and we had almost no time to clean up properly. It was only 11pm, i didn't think they would be cracking down, especially on this road we were on. To make a long story short, i took responsibility for the pot found, 5.5 grams of some decent beasters, and got charged with Simple Possession. I tried reasoning with the cop, acted all nice..but he sent me to jail because i gave him an "attitude" because i tried explaining to him that it seemed like a joke that i have to go through with this AGAIN, for smoking a plant. Also i told him that he should look up the real facts on marijuana, but i guess arguing with an ignorant prick is like talking to a wall. I ended up sitting in jail watching commercials for 6 FUCKING hours with other people before the magistrate saw me and released me. I felt so out of place sitting with all the other folks in there. Most of them were in for DUI's. One dude had shit himself lmao. Every county cop in the building was overweight, and by god i tell u they were everything you've ever heard of about cops. Every bad story you've heard about cops is true..they treat u like shit, regardless of what you've done, no matter how petty or trivial the "crime."

The judge suggested i plead not guilty, he said in front of him i wasn't guilty..i'm not 100% on what he meant. But i know i still have to pay the 570$ ticket, and if i am found guilty, i lose my license for 6 months... So i'm going to plead not guilty, and 6 jury people or w/e will decide my fate on the court date, march 23rd.

What i want to know is, do you think if South carolina eventually moves to de-criminalize marijuana to some extent, that, i may be able to expunge the charge from my record? I work for the United Parcel Service just as a laborer for now, but had plans of driving in the future, kind of a fallout plan if college didn't go well.
Or after several years, do i get the chance to expunge it? Maybe if i move states?


Any advice, sympathy, is appreciated lol. I've been through hell. Pre-trial intervention was a joke..the state just wants my money, and i don't want to give it to them. Us weed smokers arent criminals, Prohibition is the REAL danger, Cops are not defenders of society, This system is BEYOND CORRUPT and unjust, i hope some1 above smites every fucking douche cop that has ever charged some1 for something marijuana-related. Thanks.

Yeah, I spent about 9 months living in SC, I liked the the beaches and Charleston, but I wouldn't move back ever. They've got a pretty conservative, narrow-mindset over there. And it's not just the cops that are overweight....it's damn near everyone in the south. (Deep-fryer justice, I guess)
Anyways, the quite a few times I've been in a dispute with the law I've always acted extremely proper, somewhat reserved, and (this is pinnacle) acted like I thought that I was wrong and felt truly guilty...I know it's pathetic and sort of disgusting. Of course I only do this when I know I'm absolutely screwed (like when my passenger freaks out and throws the weed out the window AFTER WE'VE BEEN PULLED OVER AND THE COP IS BEHIND US....yeah, the epitome of genius) I basically give them bullshit and stroke their endless egos.... Come on, do you think me or you can really change their minds under those circumstances, this is their livelihood and, generally, law enforcement attracts a certain type of persona we all know and love...right? lol
Anyways, I've sucked up my pride for brief moments and shamelessly beguiled myself and many of my friends (and some dumbies I was giving a ride) out of at least 20 precarious situations. Was it shitty? Hell yeah! But so is probation and jail (So I've heard)
I give you a lot of props for taking responsibility like that, I've bit the bullet a few times too. Good luck, I'm sure it will work out.

Wish they'd give a shit about who they were arresting and why. Like mentioned before, trying to talk facts into them about the plant is pointless due to ignorance.

I watched a youtube vid of a cop who tasered a dude for literally no reason. The guy was pulled over, but wouldnt sign the ticket, and the cop told him to get out and for some reason the cop though he was trying to escape and TASED the poor dude. people have died from being tased before by the way..in the end i think the guy who was wronged got 40 grand from the incident. http://www.youtube.com/watch?v=sqbmasNeOmM

It's worse in some areas of the U.S. but there's no doubt that a lot of these monkeys go on their little power trips and end up hurting good people. I get all angry-emotional when i watch real shit like that happen and idk if i could restrain myself from drop-kicking and throttling a cop if i ever saw something like that up close.

if the dog smells anything from outside the car it can give them probable cause to search.

In all fairness, you should not be telling a cop your personal beliefs about something that is currently illegal. This is always always the best way to get into more shit, or the cop will just get pissed. Dude has a job to do, if you don't like it move to a 420 friendly place.
