Regina v. Santos a.k.a Tousaw Does it Again

Mr. Santos was found in possession of 414 plants, half of which were seedlings. He also had 3 kilos of dried cannabis. He grew for his own non-physician confirmed medical condition and donated the remainder to other medical patients at no cost.

He received an ABSOLUTE DISCHARGE and walked away with a 10 yr weapons prohibition.

I apologize if this had already been posted. I looked and couldn't find it elsewhere on RIU.

Tousaw was his lawyer and this was in Regina?

Edit: Never mind, I see this was in BC.

More evidence of a flawed government policy dying from non-compliance. If everyone could afford a Kirk Tousaw to defend them, the law would die rather quickly.
If everyone could afford a tousaw then they probably wouldnt need to run the risk of growing their own they could just afford to pay black market prices.
Shouldnt need an expensive lawyer to keep fighting the same cases over and over again.

Totally agree, but my point is if enough cases are thrown out, the crown will give up at some point.
I hope buddy appeals the weapons ban. Unless there was an illegal or improperly stored gun, it's a rights violation.

does it really need to come to 40,000 individual cases brought before the courts...??
they should be able to get it after a few losses.....maybe the crowns from different jurisdictions
could use some of the modern technology that we have...like text ,instagram twitter...maybe email....
snail mail.....something to communicate.....that they all are losing....their cases and maybe its time to save face....
and look like you tried to do something positive towards the proper outcome......just thinking out loud
but still time to change the laws already....you know how....so I challenge the crown attorney's to do the right thing.....instead of following flawed law....and hiding under the fact its still a law...
decide whats right mister lawyer....you should be educated enough to come up with the answer

The problem is the court only costs the defendants financially for the crown and hc its free money so they dont give two shits to keep going to court over and over again. If it came out of their own pocket i bet the second loss in a row would be the last one but who is going to say enough is enough? The judge isnt going to say ok no more of this stupidity because thats what butters his bread too.

I read the entire thing and it looks like Tousaw had tens of court cases to refer too. Honestly, if you have a doctors note keep the grow simple and as minimal as possible and im hoping you wouldnt get charged.

He defends people with 1000's of plants even 1 guy recently who had 4lbs on him and claimed personal...he won.

I guess only " WE " can make them accountable.....
If my MP was the guy responsible in government....for that particular area....
he would have to be let know that his job would depend on him cleaning up these kind of wastes
where the government uses bottomless money pits to fight individuals...that are taxpayers...
make that illegal.....end of story.
changes can easily be forced but it has to be done at the community level.....
every single government MP/MPP has a home riding or constituency ....organizing at that level against those in power....is how we can make change happen....
we all really need to be able to talk to our neighbors and discuss/plan what we can have an effect on government by
hanging the MP job on the line.......but we all have to think together ....ie.....community.....seriously its how the masses can win...
the more we network locally the more we have a shot at change....I know it sounds, impossible but its not....
If you can get someone as introverted as me to get involved....then the rest of you who actually like to socialize,
will have zero problems networking...
we can force change....it just takes organization at a local level....

The trouble is standing up in public for this cause is hard to do. Unless your in a big 420 crowd. Few want to put themselves forefront in this fight as you say by opening themselves up personally.
That's part of the problem, unless folks get caught, they usually want to stay under the radar on this subject.....hence the goons dance on. If you grow, you kinda gotta remain ...aloof. right ?

i changed jobs so I could support it. i was asked to be a witness in the tax court case for the BCCCS but had to pass..I was working for the Gov't so i don't think me standing up to the man when my employer is "the man" would look very good..i don't work there anymore so now I am free to stand my ground

But you also don't grow...correct ...You won't find many growers standing out on the street touting the subject. Easy to be mouthy when you got nothing to hide.

Dudes the weapons ban is a mandatory prohibition that goes with every discharge
There is no appeal of that, so ya even grandma growing with cancer for medical
That ends up with Kirk as her lawyer to get an absolute discharge gets an automatic weapons
Ban even if she's never even fired a bb gun in her lifetime go figure

And we all think we're anonymous....CSIS like the NSA is the only part of government that is listening!
