So I was driving around with a couple of buddies, smokin up on a mini zong that my friend just purchased at a local headshop. We're driving around for a few hours, all high as hell, driving the speed limit doing everything right using turn signals yadda yadda covering my ass as usual.

All of a sudden, I see lights behind me, my buddy stashes the bong, stashes the weed all in an airtight stash box, tucks it under the passenger seat. Everyone in the car freaking out, with the exception of myself, because I'm thinking I've done nothing wrong.

Officer walks up to the window, I roll it down, turn off the car as he instructs, lookin red eyed and hazy as shit. He asks me the dumb question, "Do you know how fast you were going back there?" I reply no sir, I believe I was going very close to the speed limit, I was distracted for a moment by a driver who cut infront of me. He tells me he pulled me over for going 48 in a 45. Seriously struggled not to laugh at this.

Of course, we just had a bunch of weed out and we were smoking so it kinda reeked, but some what covered by cigarette smell since my buddies in back were having a square before we got pulled over. So he asks the next dumb question "What have you guys been smoking in this car son?" I look him in the eyes, high as 1000 fucks, and calmly reply "Sir, my friends were just having a cigarette in the back seat, they're both over 18 if you'd like they can pass you identification for you to verify." so he mentions he smells marijuana, and this was the moment I've been waiting for for SOOOOOOO long. You see, my uncle is a lawyer. This cop was fucked from square one. Calmly, again, I reply "Sir, if you don't mind, it's awfully late and I have work in the morning, if you don't mind I would like to just take my speeding ticket and be on my way." He asks if he can search the car, and I remind him kindly that I was pulled over for speeding, not for any other reason, and that if he had any other questions that were beyond the scope of his investigation into my speeding, that my lawyer would gladly facilitate him.

The officer stares me in the eyes, gives me the look that he knows I'm fucking high as hell, I stare him down, and he says, "Don't let me catch you speeding again, and please get out of my jurisdiction safely."

He walks back to his car, like a chump. No speeding ticket because he knew it would get thrown out in court, or at MAX a $40 fine.

Drive away, turn the corner, get to the next township, bust out the bong and resume the festivities.

Know your rights. When you're pulled over don't throw your shit out the window, don't panic. The officer can ONLY investigate anything involving the original purpose for pulling you over. The ONLY way you can get caught for marijuana possession or being under the influence is if you get pulled over for driving like you're drunk. When you're driving high obey every law to the best of your ability and stay straight. No swerving and no questionable u-turns or any dumb shit.

Oh and don't be dumb. Be polite and cooperative with the police RIGHT up until they mention marijuana, maintain your politeness, but fuck cooperation at that point.

No it isn't. If the officer smelled you going by and pulled you over for reeking of MJ, maybe..... but not because he claims he smelled it while discussing a speeding ticket. If you were correct, every traffic stop could end up in a 'justified' search because the officer thought he smelled marijuana. Learn your rights.

The only two times a vehicle can be searched without your consent is with a warrant SIGNED by a judge, or if your car is impounded and a list of it's contents are needed for records to cover the impound yard. That is it. A drug dog can't even enter your vehicle. You can get out, roll up windows and lock car and then talk to cops. You always want to cooperate, but if you are ever forced to violate a right, state so and object in a calm voice and state your objection, but comply. You don't want a bad cop escalating a situation. If you were in the right, you can deal with that in court. Never give a police officer an excuse to subdue you or charge you with resisting arrest.

Second that....unless the cop just didn't want to bust you but hey does that sound reasonable to you? They are really pushing the DWI for weed now too....all over.

i got pulled over for running a YELLOW light, handcuffed on the corner with the ol lady, and two pairs of cops (four for those who cant do math) searched my car, and myself and my lady, stole at least 300 dollars in cash and "confiscated" dirt (bag of fox farms ocean forest) lights (bank of t5s) pipes alcohol and marijuana, AND i have a card but i didnt have my wallet on me. cops CAN do what eva the fuck they want. they wanted to steal my shit and give me a ticket and thats what they did (ticket was for minor in possession of alcohol and marijuana, cause as a minor /under 21/ i can GROW but i cant POSSESS) but then two days later i got pulled over doing 30 miles over the speed limit, with a similair assortment in the car and the cop only let me go because earlier that week the local drug dog had died and without a dog spotting on the car he couldnt do anything. i wasnt about to tell him it didnt stop his buddies two days before though. so it really depends on the cop and i bet your uncle vinny couldnt have saved your ass if he wanted to be a prick, so keep flauting your good karma and the devils gonna bite your balls bro.

Police Chief Magazine says it best, the smell of marijuana alone doesn't constitute probable cause. There has to be another mitigating factor to consider before conducting a warrantless search, or the officer risks having any found contraband, suppressed as evidence. An example would be smelling pot coming from your car AND you are parked at a known hang out spot that has a history of drug arrests.

This is a very gray legal area and you will have decisions going both ways, depending on who presides at the bench. I've had cops state they smell marijuana and there was NONE. They all do it, just like they all ask, how much have you had to drink tonight? when you haven't had shit. It is simple entrapment. Never answer the officer's direct question if it is not related to why you were stopped. If they ask about drugs or alcohol, simply ask "Am I under arrest sir?" (5th amendment, never testify against yourself)

Most cops are able to intimidate a civilian to permit a car search. (4th amendment violation) The cop would be crossing a gray area if they moved on to conduct a warrantless search against the wishes of the owner. Hell, tis comes directly from Police Chief Magazine.... ;p

What I mean is, most cops use the ruse of smelling marijuana in an attempt to circumvent your rights. When you read that statement, focusing on the words in red, it contradicts the first paragraph about the constitutionality of a warrantless search. The smell of marijuana alone doesn't provide probable cause, however it can be used to establish one.

Dog can't enter your vehicle. In fact, when instructed to step out of the vehicle, you should grab keys, raise windows and lock car when you exit. If that dog smells marijuana after the officer did, he has cause to search your vehicle. Yeah the cop can do whatever he wants, but if it doesn't hold up in court and they keep doing it, they'll be job hunting before long...
