I just need a slight clarification on the laws in Ohio. On the norml website it says that under 200g is a misdemeanor for possession and then cultivation says to refer to the possession section. So what I took for that is that you can have up to 200g of plants and that will only be a misdemeanor.

The question here is, is the 200g the plants weight as-is, or dried? I would assume as-is, I'm guessing the cops aren't going to trim and dry my buds before they figure out what to slap me with.

If it is 200g as-is, about how many full grown plants would that be? I don't want to go over this 200g threshold because then it becomes a felony with a minimum of 6 months in jail and $2,500 fine.

"Marihuana does not include the mature stalks of the plant, fiber produced from the stalks, oils or cake made from the seeds of the plant, or any other compound, manufacture, salt, derivative, mixture, or preparation of the mature stalks, except the resin extracted from the mature stalks, fiber, oil or cake, or the sterilized seed of the plant that is incapable of germination."

If they wanted they could probably put the whole potted plant on the scale and say, "well, that's 8 pounds". Hope to get a good lawyer and plea it down.

You are making a choice when growing. It is either worth it or not. It is up to you to make that choice.

Thanks guys. I currently live in Colorado where it's not much concern but I'm considering moving to Ohio.. I need my medicine, I can't afford pharmaceuticals, physically and financially.

if the fe.ds come into your house . they pull the plant out of the pot. and weigh it wet roots stem and all ! one plant and you look like a major player .

I'd much rather get busted with a couple plants than get busted with a bottle of percocet that's not in my name. Thanks everyone for their input.

State v. Wolpe (1984), 11 Ohio St. 3d 50 -- Though R.C. 3719.01(Q) excluded mature stalks and sterilized seeds from the definition of marijuana, the police lab is not required to separate out stalks and seeds before weighing the seized marijuana. Stalks and seeds are excluded from the gross weight only if they have already been separated from the non excluded portions of the plant. Also see State v. Jarrells (1991), 72 Ohio App. 3d 730. For discussion of previous case law, see State v. Radebaugh (1982), 5 Ohio App. 3d 152.

don't know about charging you for rootball weight as well. they can always charge let your $600 an hour attorney argue the case in court
