First offense for two plants over for a patient would be a warning anyway (and removal of the overage). Who the hell is going to check up on it anyway, and why?

The six refers to mature, flowering plants. You can actually have an additional 12 in veg, plus an unlimited number of cuttings under 12 inches.

Yeah:
Over 12" - flowering 6 plants
Over 12" - veg 12 plants
Under 12" - no limit, but over 99 plants total I believe you are getting into fed territory.

The rationale is that a patient can keep a rotation going with those numbers. Presumably the 12 veg are at a couple different stages.

Also, do yourself a favor and read the statute and the rules. It is all available at this link:
http://www.maine.gov/dhhs/dlrs/mmm/index.shtml

The six plants refers to "Mature marijuana plants", which is in the definitions within the statute. The amount of "incidental" marijuana is defined in the rules. Both documents and much more are available through the link above.

Ive never heard of such a law?
Even if there was one I don't think
its worth the risk to be 2 plants Over...if you got caught...The Lawyer fee alone would cost the equivalent of 3-4 pounds..you aren't going to average that with 2 plants not to mention the additional consequences if you don't win!
8.Defense for possession of excess marijuana. Except as provided in section 2426, a qualifying patient may assert the medical purpose for using marijuana as a defense to any prosecution involving marijuana possession and may present evidence in court that the patient's necessary medical use or cultivation circumstances warranted exceeding the amount of marijuana allowed under section 2423-A and was reasonably necessary to ensure the uninterrupted availability of marijuana for the purpose of treating or alleviating the patient's debilitating medical condition or symptoms associated with the patient's debilitating medical condition
