Florida still has harshest penalties in the country, continuing to put patients and others at risk

Last update: May 6, 2010
Marijuana policy reform not on the 2009 legislative agenda

Although President Obama and Attorney General Eric Holder have both stated that the federal government will no longer expend resources interfering with state medical marijuana laws, Florida legislators have yet to catch on to what modern scientific research, the public, and at least 14 other states already know — sick and dying patients do not belong behind bars for using medicine that has been recommended by a doctor. Please contact your legislators today and ask them to introduce medical marijuana legislation next session.

Court established defense

Despite the fact that a medical necessity defense has been established by Florida case law, patients remain at risk of being arrested and jailed because legislators have yet to enact a medical marijuana law. To review a 1991 case that outlines Florida's medical necessity defense, click here.
Public opinion in Florida

Not only have Florida courts endorsed the use of medical marijuana, so has the public. In 1997, 63% of registered Florida voters said they favor approving an amendment to the Florida Constitution legalizing "medicinal" marijuana, according to a poll by The Miami Herald.

Harsh penalties put everyone at risk

Although Florida courts, public opinion, and 14 other states reflect a trend that recognizes the legitimate use of medical marijuana, Florida patients remain exposed to the state's harsh possession laws. Every single medical marijuana patient in Florida continues to live in fear because Florida's penalties for possessing small amounts of marijuana are among the nation's toughest. You can read more about Florida's draconian marijuana laws and their impacts here.

Are you a victim of Florida's harsh marijuana laws?

For those who have been convicted of violating Florida's inhumane marijuana laws, life can be difficult for years to come. Public housing eligibility, the ability to adopt or foster a child, the right to vote, and the ability to receive student aid — to name a few — can be affected by a marijuana conviction. Please click here to learn more about what you can do if you or someone you know has been a victim of Florida's draconian marijuana laws.
Future legislation in Florida

Obviously, Florida is in need of marijuana policy reform. The time to act is now. Please contact your state legislators today and ask them to sponsor a medical marijuana bill in the Florida Legislature. After you have e-mailed your legislators, follow up with a call to their office and leave them a message reminding them that their constituents support the right of a patient and doctor to decide what treatment is best. Click here to find out who represents you in Tallahassee and locate their telephone number. If you are able to start a dialogue with one of your legislators, you can send them a copy of MP's model bill by clicking here and downloading it in PDF form. MPPs model bill is very similar to Rhode Island's law, which has been working well since 2006.
Radio activism

Another excellent way to open up the discussion about medical marijuana is to utilize the airwaves. Please click here to download and share MPPs public service announcements with radio stations that might be interested in airing these educational and entertaining messages.

It is important to remember that legislators, like you, listen to the radio and read newspapers every morning, so please be sure to take advantage of the materials we have available that employ these forms of media.

I spoke with Ray McBerry and, after telling him my story about my brothers fight with prostate cancer for 5 years, MJ giving him the ONLY relief he got the whole time, he said he support, at the minimum, decriminalizing it, or hopefully, legalizing it like the other sane states.

We have to remember they just passed it in Washington DC . So I feel its got a better chance then most think . Its not just because I want it too . I know its a up hill fight but just think of the support behind it . The NCCPN , NORML , MPP and many others have come together to fight for this . They have gathered thousands of signatures and Perry Parks will hand deliver this petitions on Wend. With the support of hopefully a couple hundred activist following him into the state house .

True. But at the same time you also have to consider that people might also decide "Well hell lets see how it works out in washington. More data right?" So IMO although it does improve our odds it dosent by much.

I am going to stay positive, If there has ever been a time to stay positive this is it. We all know the pros and cons and we all know the supporters and the non suporters but if there has ever been a time for answered prayers this is it.

More then you think . Just think for a sec . The capital of the USA its legal to use MMJ . That kinda sets the standard for the rest to follow . If it has a chance of passing its now . If every one that lives in NC that wants this bill passed would show up to support it . There would be no question if it passes or not . Just sitting around hoping it will pass wont get it done . If you cant make it call you local NCCPN rep and get your name on the petition . Call your reps let them know if they dont support the bill they wont get re-elected . Its that easy , remember they work for the ppl of NC . Ya'll elected these ppl into office and you can vote them out . Dont give them a choise , if the bill doesnt pass its their asses in a sling and stand to you gunnes . If it doesnt pass this year make sure you have marijuana friendly ppl voting on it next time .

Newport , you of all should be staying positive . Why do you have so many negative thoughts about the bill ? Have you spoken to your local reps or researched the debates being held in support of the bill ? How many activist have you sat down and spoke with . I mean real activist , not the ones sitting at home talking about how cool it would be to have this law pass . I mean the ones that are out there talking to every and anyone that will listen , going on the air of local radio stations to spread the word . The ones that have been lock up time and time again for speaking their mind about the abuse the american public has to suffer at the hand of government for the sake of profit . For speaking out against prohibition of a plant that has more healing powers in it then any pharmaceutical company can produce . These are the ppl out there trying to get this law passed for all involved and these are the ppl that need the positive feed back from the ppl that cant make it . Not to hear ( I dont think its going to pass ) . Well my friend , cant never could and never will . Its the fighters out there on the line that will get this passed . I'm not from NC but I guarantee you I have done more to help get this bill passed then 70% of the ppl from NC that it will benefit.
