NANAIMO, B.C. - RCMP have raided several marijuana dispensaries in Nanaimo.

Mounties say they have executed search warrants at three pot shops.

The warrants were served nearly three weeks after cease-and-desist letters were handed to the operators of 10 dispensaries, giving them seven days to close their doors or face possible charges.

Cpl. Jon Stuart says in a news release that two of the shops have shut down since then.

Stuart does not say if or when warrants will be served on the remaining five dispensaries.

He says the Nanaimo detachment is acting because it has received complaints about illegal marijuana storefronts selling drugs to young people or those without a prescription.

Search Warrants Executed on Three Marihuana Storefronts
Nanaimo

Over several months, Nanaimo RCMP received several complaints from the public about illegal marihuana storefronts, also referred to as marihuana dispensaries. For instance, we had a Grandmother allege her 15 year old grandchild had purchased marihuana from a storefront. Some of the storefronts were actively soliciting business by having sales people stand outside and/or waving signs to solicit customers, whether or not they had prescriptions.
The RCMP responded to these complaints and is guided by the existing laws and legislation. We do not permit people to sell legal or illegal liquor or prescription medicine on a street corner and similarly, we cannot permit an illegal substance to be sold in a similar manner, particularly when people have complained about it. There is no legal mechanism in Canada which allows for medicinal marihuana dispensaries or compassion clubs to sell or gift to the public.
On November 12, 2015, in response to the complaints, Nanaimo RCMP issued a clear and highly publicized notification to several marihuana storefronts. Nanaimo RCMP wanted to ensure there was no ambiguity, the storefronts were accurately informed and given ample opportunity to stop selling marihuana illegally. Two storefronts have since shut down. We believe issuing the notification was a fair and measured approach, providing time for consultation and compliance.
I can confirm that today, Nanaimo RCMP have executed search warrants at three storefronts. These warrants were judicially authorized and Nanaimo RCMP has worked closely with the Public Prosecution Service Canada (PPSC), from the start of these investigations.
Marihuana is regulated as a controlled substance under the Controlled Drugs and Substances Act (CDSA) which prohibits the importation, exportation, trafficking, cultivation or production, and possession of it or its derivatives, unless in accordance with the guidelines set out in the Marihuana Medical Access Regulation (MMAR) and Marihuana for Medical Purposes Regulation (MMPR). The MMAR and MMPR sets out mechanisms within which marihuana and its derivatives are legally available to patients with a prescription provided by a medical practitioner.
When I have reports of storefronts selling marihuana to youth and concerned community members approaching me about it, we are compelled to take enforcement action. Our approach has always been to address public concerns, consult our contracting partners, stakeholders and allow for our investigations to determine the way forward. That was done in this case. As these investigations will now be before the courts and other investigations are still underway, Nanaimo RCMP will not be commenting further on this issue, said Supt. will any of the busted dispensaries reopen tomorrow and will the remaining dispensaries be left alone?

If in fact they were selling to non-card holders and young teens, then they got what they deserved. I have no problems with anyone selling legit medicine to any real patient, carded or not, I do it myself, in a limited/small way I'm a cc to a handful of cancer patients. But if you're going to essentially open up a shop to become a street dealer, then you'll have to be willing to face the consequences.

Trees, Phoenix Pain Society and Nature's Source. likely these are the most problematic that cops have targeted first, nothing to do with selling to minors.

Just like using the blanket statement of saying someone is resisting arrest(even if it isnt physically being done), the whole selling to minors is an easy in for them to raid these places. Of course theres a possibility of them actually having done that.

Lets be honest, if you go through all the steps and take all the risks of opening a dispensary, how logical would it be to add an even BIGGER risk by selling cannabis to kids who can already buy it easily using other means through the BM. Doesn't add up, and theres probably a reason, especially considering from what Ive gathered, that supposedly all 3 places are accused of selling to minors, all within the same city,............

When all else fails, follow the money, or in this case the end game. Who stands to gain or profit the most from this? Pretty clear Id say, given that we know the ACTUAL amount of patients that the LP have to fight over, or should I say, lack there of

well to be fair, a few of these guys were only compassionate of their bank accounts..
reap what you sow i guess. wanna go legit, then be legit.. don't try and skirt the rules for greed. (dunno about kids, but i know some were selling to uncarded people)

i've actually no problem with BM dealers/growers; they take the risk, they earn the reward.. i can respect them more than the ones who try to cover their arse in grey area legality, then go and do stupid shit out of greed..

and while i'm against the raids, i'm not big on what most dispensaries are doing anyway.. they're only slightly more respectable than the LP's IMO.
