Ok, so I have mentioned Black's Law and Rights and stuff, so I just wanted to make something as clear as I can: I HAVE NOTHING TO DO WITH THE SOVEREIGNTY MOVEMENT
I have been on the internet for 5 years now, so I have heard of Sovereignty and the Universal Commercial Code and Maritime Admiralty Law, and to make it clear that I am not talking about that, I am going to teach you exactly what that is. Then while I do that, I will show you what I have been studying in Law and how it is different.
Ok, so Sovereignty comes from History, Gods were Sovereign, Kings were Sovereign and that eventually became "State Sovereignty" which is what States and Countries have. Then in the 1970s a Christian movement started in America called "The Sovereignty Movement". This movement is kind of focused on the idea that "God is Sovereign and is over me, not the State" and they also say that the Constitution makes them Sovereign on their land. This is the kind of ideology that pushes groups like the Bundy Ranch to do what they do.
To get to this, they have to do some crazy legal Gymnastics that actually aren't legally true. First they start off by saying "Corporations are People" then they try to tell you that your name is a Corporation. If your name is "John Doe" they say that when you go in to court and see "JOHN DOE" on any paperwork, that is not you but a Corporation that represents you. This is completely wrong. Corporations are legally considered people and can take responsibility like a person, for example in the case of the BP oil spill no one went to jail and BP was basically only charged with cleaning it up, even though they should have been banned from the Gulf as soon as it happened and someone else should have cleaned it up while they went to court to pay for the cleaning. If you want to get privileges like BP, learning about Sovereignty and Universal Commercial Code and Maritime Admiralty Law is not going to help you. Saying "JOHN DOE" does not represent you, does nothing. If you want to get the Privileges of BP, you have to either start an LLC Corporation that can act as a legal person, or start a Trust so that the Trust can act as a legal person. That is real Law, not Sovereignty bullshit.
Sovereigns also like to point at the Constitution and say "See", but they do not realize that there are supreme court cases. The supreme court "Interprets the Constitution" and it doesn't matter if you don't like it, that is what they do. But you have probably heard of a lawyer being able to look for an archaic old law that saves his client, this happens with the Supreme court all the time. If the Supreme court makes a decision it becomes "The Law of the Land" so any case that comes after that and has the same problem, just follows the same ruling made by the Supreme Court. So for example if the Supreme Court decides someone can have 1 oz of Marijuana in their house, that means every lower court should follow that. This is called "Common Law", not Sovereignty bullshit.
Then there are legal Maxims, thousands of them. When you walk into a Court room or deal with a Cop it feels like they have the law over you and even just being in court is scary, but ever since court rooms have existed (Ancient Egypt, Israel and Greece) they have been writing things down. And the "Maxims" they have written down are what have structured the procedure behind our laws.
Here are some examples of Maxims:
"A personal right of act dies with a person" this is why rich people make Trust funds for their kids, because the trust fund can act as a person to hold the money when they are no longer alive to do it themselves.
"When the plaintiff does not prove his case, the defendant is acquitted"
"External actions show internal secrets" this goes further to say that if someone is abusing an Authority given to them by law, they are Trespassers in the Law.
"The burden of proof lies on the plaintiff"
"An act of law shall prejudice no man"
"The act itself does not constitute guilt unless done with guilty intent"
""It is the duty of the Justice to administer justice to everyone seeking it from them"
"To questions of fact a judge does not answer, to questions of law the jury do not answer"
"Equity follows law"
"That which is equal and good is the law of laws"
"It is one thing to possess, another to be in possession"
"A tree is so called while growing, but wood once it ceases to grow"
These are legal Maxims, not Sovereignty bullshit.
