Here is what you do: You walk next door and let him know that you have been in contact with the police. If he doesn't have a script, that's extortion. If he still has a problem with it do call the cops. Your within your legal rights. He is not. also what if he's just setting you up. If he doesn't have a scrip your "selling to an undercover". Don't jeopardize a good thing for a f@^k bag.

Remember, Extortion is a felony. Growing your legal amount is not.

Blackmail is the crime of threatening to reveal embarrassing, disgraceful or damaging information about a person to the public, family, spouse or associates unless money is paid to purchase silence. It is a form of extortion. Because the information is usually substantially true, it is not revealing the information that is criminal, but demanding money to withhold it.
The term was originally used for the payment levied upon the farmers of the Scottish border before the 18th century to provide immunity from raids by Scottish bands. If the farmers didn't pay the mail (an old term for rent), the chieftains would steal their cattle and crops. Since this was considered evil, it was considered "black".
Blackmail has been defined in the broad sense to mean "compelling someone to act against their will or gaining or attempting to gain something of value." Courts vary on interpreting what "something of value" includes, but it is not necessarily a money payment in all cases.
State laws vary, but the following is an example of a state blackmail statute:
"21-3428. Blackmail.
Blackmail is gaining or attempting to gain anything of value or compelling another to act against such person's will, by threatening to communicate accusations or statements about any person that would subject such person or any other person to public ridicule, contempt or degradation.
Blackmail is a severity level 7, nonperson felony"

Blackmail that mutha effer back!!! If you are under the legal limit and he is not a medical patient than him asking you for 8ounces of herb is more illegal in the state of california than you growing it legally. Set that bitch up! I understand you dont want law enforcement involved but you could talk to a friend or friend of a friend in the law enforcment and see what there thoughts are about your crop. If all is safe than tell them the situation and have a patrol car waiting for the NICE NEIGHBOR to pick up his 8oz of marijuana and then bust that bitch.

O.K. I'm back with an update.

Bottom line, our little sting operation to find out who it is fell apart. We had people watching and when it was time for the next shift, well honestly the person who took over didn't follow the plan and totally fucked it up. I don't want to go into too many details, but our guard just basically jumped the gun and scared the guy off too soon. This all took place in a rural area with no lighting whatsoever.

This is all we know. A guy came to the pick up site, we know the color of the car and the type. That is all. He took off before he even got the nice little note I had left for him. We do know the direction he came from, which happens to be a dead end street. The person watching (and blew the operation) was not able to identify the person.

I was so pissed off at the person who totally blew our plan. So pretty much I have gotten no sleep for the past 2 nights. We will have our garden guarded 24/7 in addition to cameras.

I really don't fear law enforcement as we truly are legal. I had a guy that I know who belongs to a legit collective come out to my house and he says everything is cool as far as us being within the law. He has dealt with law enforcement many times. I just really would feel better if I knew who this blackmailer is cause I just don't know what other shit they will try to pull. Get what I'm saying? We will be keeping our eyes out for the vehicle.

As far as people saying we brought this on ourselves for growing outside, I do understand the point you are making. However, I know many people who do this and they have NEVER had anything like this happen to them. I don't exactly have my garden out in the open, I live in a rural area which means somebody is trespassing on my property.

Sorry I didn't come back to report sooner, but I'm tired and disgusted with the whole thing. I will be at work tonight.

Extortion Penalties
California extortion, including bribery and blackmail are serious criminal offenses usually charged as a felony. These crimes are punishable by up to 4 years in state prison and / or fines of up to ($10,000) ten thousand dollars or more.

just tell him you know that his crime is more punishable than yours(in the local sense). Chances are, the feds don't even have the means to deal with you anyway. Local authorities do have the means to deal with him though.

Your bumbling partner may have scared the guy off. That's not necessarily a bad thing. The asshat may just leave you alone now. Keep up your guard just in case.

I disagree with those who state you brought this on yourself. This dude simply snooped around and found your legal grow.

If you are still wary of law enforcement, that's fine. Can't say I blame you. Wait for the next move from this cock-knocker and collect all evidence. If the situation calls for it, have all evidence ready for when you do call the law. You don't have to explain yourself to the police as to why you did not contact them sooner. What can they do before the fact? Not a fucking thing. The local yokels do not have have the kind of investigatory resources to squander on a case such as this - as it stands now - and I for one am glad for it.

His next move may not come about at all now. Chances are good that he will look for another victim now - unless he is desperate.

and what was the plan once that ONE "guard" had confronted the extorter?

If you know the make and color of the vehicle, report that to police along with the evidence you have against this clown.

I know we are talkin 8 oz. here do you think if it were 8 lbs. it would be a different story? You need to notify the authorities.

I'm only halfway through the thread, but dude, be smart. Put the letter in a bag so it doesn't get contaminated and can be used for evidence, look around the internet and contact a good lawyer that specializes in Marujuana laws, then go to the cop with the letter and the lawyer. DO NOT go to the cops without your lawyer, if this is a setup from some angsty pig, then you need that lawyer to protect yourself.

This is real life not some episode of the Sopranos, don't ruin your life by doing something stupid.....

If a cop or an inside friend is doing it; either way EXTORTION is ILLEGAL and PUNISHABLE by LAW.
Law enforcment cannot set you up to create a case against you.

Neither extortion nor blackmail require a threat of a criminal act, such as violence, merely a threat used to elicit actions, money, or property from the object of the extortion. Such threats include the filing of lawsuits, reports (true or not) of criminal behavior to the police, revelation of damaging facts (such as pictures of the object of the extortion in a compromising position), etc. - source wikipedia.org

No offense taken. Mainly our neighbors are comprised off white people. I know of 1 hispanic household, 1 russian household that are also in our neighborhood though I don't know everybody. Our friends are a mix of white and hispanic people.

your partner is in on it!
LOL - I've been thinking the same thing. So the partner is out there watching for the guy, then scares him off (I mean come ON here - ANYone could sit still long enough to set a trap like this, right?) BEFORE he could tell what he looked like? I know it must have been dark out there, but depending on how "rural" you are, he probably had his headlights on to see where he was going...some of those back roads can be dangerous w/o lights on.
If it were me, I would've been sitting out there with a camera + flash and a hand-gun in case he got rowdy and tried to attack me (OK - I'm a woman and likely couldn't go fist to fist with any normal sized guy). Sit quiet as a mouse, then when the person was reaching for the bag, snap the picture. The flash would've blinded him long enough for a getaway. Also, I wouldn't have said a damn word to him when I did it...would've kept him wondering who had his picture.

I know one thing for sure though...I'd be either getting and training some big ass dogs to watch my property, or set up some bear traps around the grow.

Best of luck, and keep us posted.:blsmoke:
