HEADS UP MMJ! Card holders!! The Atf wants your guns and the crooks want your money!

2 things came to my attention this morning that I have not seen discussed yet so here goes:

1) The Department of Justice and BATF (Bureau of Alcohol, Tobacco & Firearms) sent a memo to all firearms dealers in states that have a Medical MJ program back in Sept. defining cardholders as criminals. http://stopthedrugwar.org/chronicle/2011/sep/28/atf_says_no_guns_medical_marijua

So what I take this to mean is that even though I can have my medicine, if for some reason the local 5.0 want to bust my balls I can be put up on weapons misconduct. Thats some BULLSHIT right there. I don't know about the rest of Ya'll, but I have always been the A-typical Arizonan ( at least what the rest of the damned country and even the world envision as an Arizonan), so yeah Ima gun-toten Redneck, and this is quite concerning.


2) I believe it was Pixiduster that was telling everyone (thats right Ima lurker) about the renewal on her card and you gotta go see the Doc again to renew. Well I went and read it at AZ DHS for myself and dammit thats right! That crook schlepped my for $200 last time. I think when we get all these petitions and revisions and all the politico BS rolling to repeal the 25 mile rule, we need to change the Renewal process as well, I don't mind paying the fee to the state, but 16,000 (or so) patients x $200 = $3.2 MIL last year in Dr. Pockets! And I dont believe that was taxable income cuz that Doc wanted CASH only.

i went to doctor today, and he told me he still won't sign the application, but will give me a letter stating my debilitating condition to take to a doctor who will sign the application. What a chicken shit! After I get the letter I want, I'm changing doctors.

Fucking right! This whole law will go up in flames if patients aren't clear in voicing there demands.

just because the atf released the memo it does not mean it will stand up at trial. The original conflict was that some MMJ patients thought it would be a good idea to use their MMJ cards as their state ID instead of the drivers license. this put gun dealers in an unsafe position because the patients were still marking no on the drug section but showing their MMJ card as ID. Use your real ID and don't worry about the feds. the question asks if you are an unlawful user of any drug including marijuana. I do not feel I am an unlawful user of marijuana, a medical doctor has recommended it to me as a treatment and the state even recognizes my medical use as valid. I think it would be hard for the government to argue their case if anyone was ever tried under this memo.

also local police really should not have a stance on you having a gun, because it is their job to enforce the laws of az, not federal laws.

the atf regulation is void under the tenth amendment of the constitution and doesn't fall under interstate commerce so the feds cant touch it.
as for the 25 mile rule, we need to get rid of it, its a violation of the constitutions equal protection act.

as for the renewal fees, i don't mind, it was one of the ways we convinced voters to pass it by promising the state revenue. and in my opinion we want the state on our side because states rights protects us against the federal government and they might be a common ally.

Agreed I have no problem paying renewal fees. I also agree the 25 mile rule needs to go. If they open 1 shop in Mesa, it ruins it for the whole city cause Mesa in only like 22 miles wide. And I bet they'll place the dispensaries about 45 miles apart so their zones overlap. It's bullshit. No one else has to drive 25 miles for their Meds, there's cvs and walmarts everywhere.

Side note, anyone trying any outdoor this year?

Mind you its not paying the States fee that I have a beef with, but frankly the doc in many cases does nothing more than review your file. And the fee is beyond that of a regular visit? I question the need for that review, the state doesn't require that I take another driving test every year? Even a DOT Physical is every other year.

yah I agree, paying the doc again is rediculous! like your illness is going to magically go away. lol I was lucky because my injury was in 2001 so getting medical records almost impossible .
