as long as the controlled substances act remains in effect the congress and president dont decide shit regarding cannabis. this is all handled by underlings wrapped in a magic cloak of immunity while exercising the authority granted them by congress, and congress is shielded by the "independence and integrity" of the appointed bureaucrats. in the end most of the regulatory poweer regarding just about everything that affects the average person's life is run not by congress or the courts but by faceless mandarins working in the new forbidden city of washington. this army of anonymous eunuchs decide what substances go in which schedule, how and where federal law enforcement resources (and to a great degree the state's resources too) will be allocated, how prosecutions will be handled, what charges will be filed and which shall be ignored plea bargained or dismissed, how laws will be enforced before a supreme court ruling (notice they rarely strike down a law any more they just nudge it in a new direction) and how the supreme court ruling will be interpreted afterwards, until a new ruling changes that "opinion"
these eunuchs, the army of "civil servants" who simply cannot be dethroned by anything short of a prison term or an autopsy are the bastards you will have to deal with, and if it aint in their rule book, your "creation" is heresy, and you will be run out of town on a rail or burned at the stake. no bank or financial institution in the country will play russian roulette with the ftc, dea fda irs fbi sec or any of a variety of other agencies who will line up outside the door for their turn to drop a load in your mouth and take whatever money you may have accrued through your endeavour.
play it smart, and dont dice with the devil. lobby for a change in the laws, speak openly and plainly in your city, state and federal representative's offices and public forums, but do NOT try to out-lawyer the eunuchs in washington. they wrote the rules of the game, and can change them reinterpret them or ignore them at their pleasure.
