yeah they can and depending where you are there is a mandatory minimum sentance like where i live even for 1 small sprout you get a mandatory 5 years no exceptions

depending on the state and how many plants (4 inches tall) you were growing they'd probably go lightly on you. its state by state. where i live the marijuana laws are pretty leniant. its actually been passed so that marijuana is the least focus by cops here because they feel that theres too much worse shit going on to convict people for pot.
like if you have less than a gram on you... they confiscate and let you go. and if you have more they typically give a tiny charge. no jailtime. of course if you're carrying around tons of weed thats not going to look good on your part. but in my opinion, if you're just smoking for personal use theres no use for you to be out in public with large amounts of weed. take 2 or 3 bowls out of your stash put em in a photo container or one of those tight lock pens they sell at the smoke shops and call it good. less risk.
