Unfortunately because of this I dont think im going to be growing much longer...once this grow is finished im done until I get out of this fucking state.










Florida Attorney General Bill McCollum (R), an inveterate drug warrior dating back to his days in the US Congress, and two hard-line state legislators have unveiled a bill for the 2008 state session that attempts to crack down on the Sunshine State's flourishing indoor marijuana growing industry. The bill, which is not yet available on the Florida legislature's web site, would dramatically decrease the number of growing plants needed to prosecute someone as a drug trafficker, a first-degree felony with a mandatory minimum three-year prison sentence.

Under current Florida law, growers can be charged as traffickers only if they grow more than 300 plants. Federal marijuana laws require 100 plants to trigger the equivalent offense. But under the "Marijuana Grow House Eradication Act," it would take only 25 plants to trigger a trafficking charge. But there is more nastiness embedded in the measure. It would also create new penalties for those who own a house for the purpose of growing marijuana and those who live in the house or take care of the grow op. It would also ratchet up penalties for people who have both kids and a grow op, and ratchet them up even higher if the kids are three or under.
The bill is a response to an apparent explosion in marijuana grows in Florida. According to McCollum's press release announcing the measure, indoor grow ops were detected in 41 of Florida's 67 counties. The number of indoor grows busted in Florida ranks it second only to California, the release said.
The bill will not be heard until next spring's legislative session, but that didn't stop McCollum and his legislative and law enforcement allies from getting the ball rolling earlier this month. "As Florida's Attorney General, my priority is protecting our children and our communities from the devastation of illegal drugs," said McCollum. "This legislation targets those who grow marijuana for profit."
"Every time law enforcement can detect a grow house and arrest those involved with it, less crime will be on our streets," said cosponsor Senator Steve Oelrich (R-Gainesville), adding that the main purpose of this legislation is eliminating the spread of illegal drugs in Florida. "This legislation will provide law enforcement with critical tools to get these narcotics out of our kids' hands and put drug traffickers behind bars."
"In Florida, those who use grow houses to traffic drugs belong in prison," added Representative Nick Thompson (R-Fort Myers). "Under this legislation we are clearly telling drug dealers, 'if you grow, you go!'"
"Whether grown outdoors or in a garage, marijuana today is extremely potent and dangerous and the cultivation of this illicit drug will not be tolerated by DEA," chimed in Mark Trouville, Special Agent in Charge of the DEA Miami Field Division.
With some months until the bill is actually considered, saner heads will have time to craft a response. It remains to be seen if they will emerge to do so.

I left that freakin' state 9 months ago and was sad.....because it's home.....but with this post I am HAPPY as hell! Where I'm at it is still a hard charge if you get caught, but it's not like THAT! Shame on Florida.....shame on legislators who STILL refuse to endorse marijuana!

Does this mean that the 25 can represent 25 plants also? The 2000 can represent either lbs or individual plants, but what about the 25?
Note the MMS or mandatory minumum sentence. Thats 3 years lost no matter how good your lawyer is.

Don't move to Oklahoma. I think they have Florida beat.:cry:

1000 plants or less felony 2 years - life plus $20,000
More than 1000 plants felony 20 years - life plus $50,000

^^^ Not a bill.....it's current law.

Sad to see .. Also If this goes through you will have more states follow .. "This thing of ours " will indeed get worse before it gets better . Until they (the govt) can figure a way to get money off of it . We will have to put up with the laws they throw in front of us ... Or move to a state where it is tolarated (spelled wrong I know )

i dont know why you would worry other then the fact that you post a lot of info on sites like this.. you've seen my setup but i dont have it plastered all over here. you could do a lot to ensure your privacy.

do you fit into the category of people they want to arrest and jail? own a house just for growing? selling? "In Florida, those who use grow houses to traffic drugs belong in prison"... but do YOU belong in prison?

for the most part you grow for your personal consumption - its the statements to the contrary i would avoid.

lets assume I get caught one day growing 12 plants in a closet in my house.... (for the record i do not grow marijuana)

i will gladly go to court and request a trial jury. i want a jury of my peers to make a decision about me. do i belong in prison? should they support my prison time with their hard earned tax dollars? did i do any of the things that "the law" has said are so horrible? did i sell weed or give weed to anyone?

'the law' is always talking about the things they are trying to stop.. sale and cultivation (and by cultivation they imply the intent to sell).. by growing my own personal comsumption weed i STOPPED a few things from happening. i decreased the demand for marijuana on the street by 1. i put $100 a week less into the pockets of "terrorists". i stopped supporting large scale grow ops that sell to kids.

now, i know what i did was STILL illegal.. was i INSANE? Yes, maybe i was insane... maybe i was FUCKING CRAZY because i thought my government was making a poor decision on my behalf. Maybe i should trust my government... stop smoking weed and join a good church. Maybe i should replace the weed with alcohol, because they can TAX that.

TAX.... if the govt could figure out a way to TAX me for growing weed in a 2x4 foot space of my own fucking house it wouldn't be illegal..

(yes im high)

anyhow... i basically believe that i can get ONE member of that jury to agree with me... what percentage of our population smokes weed? 1 out of 12? or more than that? a LOT More than 1 of 12...

advice for you.. scale down for personal use only, quit posting so much info, keep a lawyer on retainer, get rid of anything else illegal going on at the house (dont download pictures of chicks fuckin mountain lions cause beastiality is illegal), do a search for yourself on google for names that you use to use online besides "Nowstopwhining" cause theres a lot of information to be found out there.. if you dont know what im talking about you know how to find me for a chat. =]

Why the hell would they want to throw someone in jail for life for growing weed when rapists are getting released in 4 years?

I doubt they'll pass that in Florida, but I've been surprised before.

This pisses me off! If we have that many people growing then that means there is a market for it! People want it and are going to use it and we have a few legislatures telling the masses NO.

How do we go about getting legislation on the ballot for public vote when the dickheads running things are all against it and won't write such legislation?

Seriously .... we Floridians need to organize and do something to stop this nonsense before its too late. :peace:

well how much are you growing florida girl? stay under the 24 then? I mean if your paying $80U.S. for 3.5 you don't need to grow that much to make a profit right? why be greedy? what it showed is that they want to irradicate growing marijuana for profit/distribution. I mean lets be serious here, I think 20 plants is more than enough for yourself and a bit of extra pocket money for here and there. that legislation shouldn't even effect people like us even though thats in the florida state.

Now the sign that Viredd said in nevada" Don't gamble with marijuana in nevada" Posession 20yrs,sales is life. then you have something to worry about. unless everyone here is a big time commercial grower. I'm just trying to make light of this, no diss. I mean they still let you have 24 plants technically, whats the problem?

letting you still have 24 plants is not considered zero tolerance

they don't let you have 1 plant. you read something wrong apparently. the law will change from 300 plants to 25 plants for trafficking but still the laws remain for cultivation. 20 grams or less 1 year. 20 grams up to 25 pounds is 5 years.

under the new bill more than 25 plants would bring a 3 year mandatory minimum sentence.

Any conviction causes driver's license suspension for 6 months to 2 years.
