does the 21 days count only business days?

The 21 days you gotta wait after the state cashes your check for a medical mj card, after the 21 days your suppose to be somewhat protected. so just curious how im suppose to be counting these days.

Honestly, I hear a random number everytime someone talks about this. When I talked to my lawyer and what it said on my application at least was 12 days.

I haven't done it myself but I've heard first hand from a stranger and second hand from a friend of a different stranger that they went down to Lansing that day and had their paperwork finished and became legal. They could be full of shit but if you're on a time line I'd look into it.

you are not on any timeline from the time your 21 days are up you are considered legal and can buy on your paperwork and proofs of payment. i have not recieved a card, but was able to go in and buy clones and got pulled over on the way home with my clones and was fine.... i have a friend also has not recieved his card but can buy mj and supplies. i have no clue if you can go to lansing and speed up the actual card. but its kinda pointless. your legal now your good to buy and smoke.

ok, here are some of the laws/rules form the Mi.gov MDCH MMJ site.

R 333.113 Registration approval; denial.
Rule 13. (1) Pursuant to section 6(c) of the act, the department shall
approve or deny an application within 15 days of receiving a completed
application and the requisite fee.

*interesting note to know*
2 (5) If the department denies an application, the department shall mail the
applicant a denial letter within 15 days of receipt of the completed
application. The denial letter shall be sent by certified mail to the address
listed on the application form and shall state the reasons for denial and
when the applicant may reapply.
(6) Denial of a registry identification card shall be considered a final
department action, subject to judicial review.

Question: Do I need to keep a copy of my application and any other information I send to the MMMP?
Answer: Yes. If your application has not yet been approved, denied or terminated you may provide law enforcement with a copy of your written documentation submitted to the department; you must also submit proof of the date of mailing or other transmission of the documentation. This documentation shall have the same legal effect as a registry identification card, until such time as you receive your card or you have received notification that your application has been approved, denied or terminated.
So in other words for the new people looking for info.

Make copies of everything BEFORE YOU SEND IT IN.

include a copy of your check or m/o with a copy of your paperwork and keep it. Send it REGISTERED MAIL so they have to sign for it. proves date they recieved it.
Keep checking your bank for the cashed check. as soon as its cashed, get a Copy of the Cashed check and put it with your other copys, and KEEP THEM WITH YOU AT ALL TIMES! until you get your hard card.

its a smart idea to make a few copies and keep them around. Even mail one registered mail to yourself. this is a way of making paperwork legal. when you mail a will and testament, a deed, or paperwork like your MMJ paperwork thru the mail to yourself, it noterizes a Date via the mailing post mark, that is emmisable as a legal transaction date in the court systems. keep the copies you mailed to yourself in a safty lock box, or fireproof box incase you ever find you need to prove your submission of paperwork.


so if you read the first section it says, once the MMJ Dept of the MDCH receives the paperwork (why you send it registered) they have only 15 days to make a decision to approve or deny an application. upon approval (what ever day that is, the 1st day the recieved it or the 15th day ) they then have 5 days to approve the card.
So assuming they opened your application on the 15th day after recieving it, they have 5 days to deny the app, which means an immediate registered letter sent to you stateing your denied, or 5 days to issue your card.

So in the worst case scenario if approved, you have 20 days between the day they received it and the end of the time they have available to send you your card, or a denial letter. So at 21 days (not business days, but straight actual days) you will of supposed to recieve either a Card, or Denial letter.

Seeing they are 4 months behind in the processing of the actual hard cards, on day 21, your paper work, as long as you have proper copies of

1. your application
2. Drs Recommendation Approval that is Signed
3. your Drivers License or State Issued I.D.
4. Registered mial slip showing date you mailed, and date they recieved them.
5. a copy of your Check or Money Order
6. a copy of your Cashed Check or Money order.
7. 21 days wait


you keep all these copies together, and after 21 days your considered accepted as a Pt/CG for the Mi MMMA of '08. unless you get a denial letter at ANY time after sending in your app. even if the check was cashed, if you get a denial you are NOT a Pt/CG or covered under the protections of the MMMA 08 act. at which time you MUST re apply, in which you have one year to do so, or request a FULL REFUND of your 100.00 application fee. They can NOT keep the 100.00 If you are not ACCEPTED as a Pt or CG here in Mi.

My 21 days will be up this Wed (day they Recieved it), or this Friday (day they cashed the check).

But IMO, by Cashing the check, they signified i have been accepted, and they have 5 days to issue my card. so in my personal oppinion, im not a lawyer after all, I believe the way the law actually reads, if they Cash your Check or Money Order, you have been accepted, and per the law, you SHOULD recieve your hard card (if they were not behind on issueing them by 4 months) in 5 days of cashing the check.

So by that angle, i SHould of been legal 2 weeks ago. BUT to save grace, and allow for all the days stated in the wording, the 21 days is a good number to go by, as it has alloted the state its full 20 days to either issue a card, or denial letter.




Now. I almost did this, but with gas prices decided to mail it out. but you can infact go to the Lansing MDCH MMJ department office. and go up to the counter hand them your application, 100.00 check or m.o. and get your paperwork accepted and stamped, as long as you have everything in order.

I know a couple guys that have done this, and left the MDCH office, and went directly to one of the Dispensorys in lansing, and made their first legal purchase.

i know this is a long read, but considering the issue at hand, and the consequences of not understanding the rules or the consequences, i think it is a deserved short read.
