can my parents house get confiscated?

i am growing at my parents house with their permission of course. lately there been alot of pot growers getting busted and lost their house around here. im growing in a self built storage room full of funitures in the back yard. if by any chance i get caught ill tell them that my parents didnt know anything about the grow. that i rented the room to keep my funitures in and always kept the door locked. can my parents house still get taken away? i live in california by the way.

The way law enforcement usually works, is if they "think" they can take property, they take it. Wrong or right, your parents would have to fight to prove that they didn't know anything and the house was not used for drugs or other crimes. If there is a large mortgage, they usually won't take due to they will also take over the mortgage and would have to pay...but if the property is payed off, or very close they could take it.
During the time to fight to get it back, I am pretty sure they won't have use of the house...but I am not sure on that one and thats what lawyers are for.

we lived here for 17 yrs only time police came knocking was wen we or our neighbors house got robbed. no1 in the house has ever been arrested. only criminal activity:roll: goin on is me smoking and growing. the house was paid off but my sister took out a loan 3 yrs ago i think its close to being pay off now:-(. any law majors here can enlighten me or give any advice? i just dont want anything happen to my parents. sorry stop growing isn't an option.:eyesmoke:

Your in Cali man! All you need is a couple hundred bucks and a sympathetic doctor. Even I know it's not hard to get a med card and I'm in Georgia. Start by checking NORML's website...

Even if you don't have a medical history, if cannabis helps you, I dont know what you have that would constitute it, that's between you and your doctor. But I would at least set some appointments with doctors and talk to them. The worst is that you would be denied and still have your money in your pocket.

I own a pharmacy and medical supply business and the day that my state allows people to grow medically. Im taking all my cancer paperwork, herniated disc mris and all that and im going to build the ultimite grow ever inside my pharmacy, right next to the compounding room....i envy you cali-dudes.....i have a million dollars i could spend on a grow and id gladly do it. Please barack help a homeboy out yo.

Why not move here if money's not a problem?

Life's too short to wait for a fucked up government and draconian laws to come around. We all wish our government would have compassion for people in need and wish and believe it will happen in our lifetime.

Dont wait for all that, if cannabis helps you that much, move here!

Your post is 100% accurate,i know this because I HAVE LOST A HOME TO SEIZURE LAWS,i have a few things i'd like to point out,what happens when they seize a home is that they claim ownership from the moment seizure laws are used & the prosecutor files the paperwork,once the paperwork is filed all occupants will be evicted using the local evection laws,they will evect women & small children no matter the circumstances,they threw my wife out on the spot.

At the time of seizure & all through the process of trying to get them to stop the lein on the property the home owner is still 100% responsible to make the house payment,the time spent defending the seizure depends heavily on the amount owed on hte home,if the home can be sold by the state & turn any profit at all after the mortgage company is paid then no amount of lawyer work will get the home back,the prosecutor will spend $,150,000 of takpayer money to reap a $10,000 profit from the sale of the home,that way they look tough on crime as well as bring in income to the dept.

As for the home owners/parents getting out of any trroubler because your a tennant or because they were not aware that will noty help them,we all know that ignorance of hte law is no excuse,its also been proven that knowledge of illegal activity is not paramount when deciding on guilt,it is the home owners responsibility to be aware of all conditions in the home in which they live,the only way ignorance of illegal activity vcan be used with 100% success is if the property owner does not reside at the property in question.

In these tough economic times & with all governmentys being strapped for cash i'd say you can bet the farm that the prosecutor will seize all assets including the home,you also need to considwer this,look at how hard government is fighting to retain control over marijuana,the scare tactic info they submit to the public changes like underwear,they will do or say anything needed to retain control of this drug,they are proving aily that they are planning on fighting tooth & nail right up to the bitter end,marijuana seizures are the cash cow of government & not something they will let go without fighting to the end,with more & more people having the right to grow leghally they have allready lost great deals of cash from seizures,they are now forcing seizure laws in every possible oportunity to recoup some of these losses.

Remember this,every home that is seized pays a cop's salary for long periods,now you decide weather the government thinks your parents home looks like a juicy acqisition that will pay for police that are getting laid off daily.
