Aphids or fungus gnats????????????

1st time grower can any one help me identify.... there 2 Months old from seed in soil perl light. THey really like to hang out under the leaves or sometimes the stem . Also im finding lil black dots almost looks like resin on the leaves a shiny lil.blk spot.. Plzzz help

Aphids have 6 legs and the antennae

These appear to have 8 legs... Fungus gnats also have 6 legs
 
It was my understanding most aphids dont fly.... Looks like the gnats ive had and sticky paper and diatomaceous earth cured that
Well aphids are complex, if you have a really large population of root aphids they can go to a stage that has wings. But they are also just crawlers of various stages. They are also nasty because they can reproduce like mad as they can do it asexually. They have different walker stages too, one tiny in the roots only and a larger one that will crawl up and feed above the soil line. There are so many different species too so it's mega complicated.

Honestly, this is a new one to me. I have not yet identified a bug like that on any of my plants, winged, 8 legs, apparently damaging the plant. I am fixin' to learn something in this thread. I hope someone can tell us what it is.
 
I am not sure this pest is a soil dweller at all. Has any life been identified in the soil, like something not winged?
 
There really not in the soil or visable they really like to be under the leaves that's were I usually find them
. I got this neem oil spray but I'm still finding them coming back not as much but they are
