a question for patients in montana

Hey guys, I have a question for you guys up in montana. If i have my oregon medical marijuana card, does that mean i can obtain medicine from one of your dispensaries while I'm on vacation in your state? I have heard that montana allows other states cards and I'm frequently driving through missoula to go to west yellowstone. If anyone can help me out i would be most grateful!

I am here with an out of state card and found 2 in butte that honor other states card, itll vary by the dispensary since law is so vague

I wasn't aware there was any places in Butte. That's great because it will only be around a 2 hour trip from where i will be staying if I need to come back. I'm not sure what the dispensaries are like over there but do you think they would carry hash or oil?

I'm not sure if it's actually legal for them to sell to you, but that doesn't mean you can't find one willing to.

There is nothing written in the law stating caregivers cannot provide meds to out of state patients.......with that said it also does not say it is legal. It is really hit or miss whether or not a dispensary will sell to you. Many will......some won't......some it depends on how they are feeling that day ;p. There are so many grey areas in the current innitiative......here is a link to the complete initiative, see what you make of it.

Depending on what happens in the 2011 legistature I was thinkin about starting a travel agency for Med Patients, Flying High Travel. Set up vacation packages for patients, skiing and snowboarding, hunting, etc

RE: DJ GREEN THUMB , the law states that any out of state patient shall be covered under the montana medical marijuana act. it also says as a provider i can only provide to patient whom i have a card for. It is illegal to supply medicine to anyone with an out of state card. Out of staters are allowed to possess and use marijuana as medicine but cannot purchase it while in montana-bring your own bud.

1-406-444 0596 this is the phone # to the dept of health and human services-the dept that issues med cards. you should talk to them about the matter, and possibly a lawyer too. ive talked to both- i have signed up around 60 people in the last 4 months- 8 were out of staters who BY LAW had to aquire a MT card by seeing a dr in mt as a resident and applyinmg and waiting 2 months for the card like the rest of us.

you are not a lawyer-it is people like you who have caused the problems with the system here in MT and haver caused it to be sent to the legislature for regulation-thanks bud get a clue

LOL!!!!!! Where did I give anyone any legal advise, I am simply going on what is written. There are MANY gray areas in the law, left there INTENTIONALLY by Tom Daubert and the group that originally wrote Initiative NO 148. I am a member of the Montana Medical Growers Assoc and I was simply telling the OP what is going on in our state, and there are dispensaries that will sell to out of state cardholders, whether it is specifically written in the initiative or not, I personally am not one who is willing but there are those that will. Do YOU even know what is on the legislative agenda this year or are you talking out of the side of your face? I have been to state capital to work with the lobbyists fighting for the right of the patients and caregivers in our state while Sen Jim Shockley has an agenda to repeal 148..........what are you doing besides coming on our board and talking shit?

been there done that also green thumb-we have probably met. i am aware of the states intentions- i have read the proposals and the lengthy explanation of how they will work. Grey areas are nothing more than bending of the law to suit peoples needs whether it be legal or not. laws dont bend-they break. we are where we are today facing annihaltion from the state becaus etoo many people are breaking the laws and calling it a grey area. law enforcement allows it because it gives them propaganda to use against us. If every one would have played by the rules we wouldnt be here today. As an owner of a dispensary it is really black and white on what i can and cannt do. I dont see these grey areas-they are illegal not grey. really tired of seeing unqualified people in these forums interpreting the law on their own and spreading it as gospel.

read the little paragraph above where the caregiver sihns on the state application-cannt sell to out of staters because they donot have a card with your name on it. The law states you are presumed to be medicinal use if you are within your capacity limits AND POSSESS A CARD ISSUED BY THE REGISTRY. WHERES YOUR GREY AREA NOW GREEN THUMB. CANNT SELL TO OUT OF STATERS UNTIL THEY HAVE A CARD-CANNT SELL TO YOUR OWN PATIENTS UNTIL THEIR CARD ARRIVES IN THE MAIL.

GREY AREAS ARE AN EXCUSE BY REPEALER TO USE AGAINST US
GREY AREAS ARE AN EXCUSE BY UN ETHICAL CAREGIVERS TO "BEND/BREAK" THE LAW.

You got it man. I see these store front places haveing the same people coming in and buying an oz every other day or so and going out ant selling it onthe black market. And that Crist guy smoking on the steps of the capital. These are the reasons for the up coming law changes. I only hope that with all the Republicans in the capital we come out ok. We had a good thing going for a few years while everyone was still under ground. Now after the big O (Obama) said not to screw with the med pot states as they did when G Dub was in office, it seenms like everyone thought it was ok to go public and snub there nose at the law.

i as a dispensary/caregiver can only provide meds to patients that i have a card for. the application to the state is a contract i signed between me, the patient, and the state of montana. i cannot provide meds to out of staters until they get a card from montana with their name on it. The law only protects out of staters from prosecution for possessing meds from their home state.....406-444-0596 that is the phone number to the state offic ethat issues med cards....call them they will tell you the same...don't believe misguided, misinformed caregivers
