guy #1 owns the property. guy #2 rents the property, guy #3 actually lives there. guy #4 raises on land that surrounds dwelling. and shit hits the fan...who will be left holdin the bag,guy #3 ?....a farmhouse on hundreds of acres and house is fenced to separate from cattle...scenario #1 plants are in house and scenario #2 plants are on land where cattle are....hope this is not too confusin..

this could go many different ways, not to mention the sever confusion caused just by the language of this post, but my guess, the person in possesion in a literal sense or the person that is hiding or protecting the marijuana would be in the most trouble, followed by the home owner, so prob the man who live there will bein the most trouble, then they would go after the home owner then any sorrounding people or anything like that may be able to be charged with obstruction of just. or something like that if they failed to report something suspcious...good luck

yes he pays the owner rent for land rights to raise cattle on farm that surrounds this house.

one more question for my learned fellows: #1 owns farm,#2 pays #1 for rights to raise cattle on farm,and a hypothetical #3 (unknown person) plants maryjane on farm and shit hits the fan. who would be liable?...#1 and #2 know nothing about maryjane.

I believe as long as the home owner was legitimately unaware of the illegal activities that all fault would fall on the person living on the property performing the illegal activities. In your second case where it was a third uninvolved party that planted the crops, it would be hard for the person leasing the land to prove they didn't plant them, unless it was them that reported it to the police. That being the case the leasee might get in trouble if the plants were found by the police or a third party and reported, however again if the land owner was legitimately unaware of their presence I believe he would still be in the clear. I'm not 100% on the laws where I'm at and it very well may depend on where you live, or what time of the month it is for the cops, how they will handle it.

john,cattle guy is not payin other peoples rent. he's payin for land around said house. another person will be payin rent for the house...this is a fenced in farmhouse with a gate that leads back to the to the farm .....the only connection cattle guy has to house is the entrance to the farm..only one road leads in to this place.. i'm confusin the hell out of everybody but this is important..lol

ps:the guy who owns the place lives far away and rent is sent to him via us mail..olds cattle guy only comes around occasionally...the cattle usually just eat grass.

very close. one guy owns farm(house included) one guy rents farm for cattle,hay,etc..one guy rents house and lives in it but another guy gets the money from said fellow and sends it to owner. lol...now i've got myself confused. in other words. the guy who lives in the house and pays the rent has no contact with owner.

where i live "the man" is the one with the handcuffs and badge. everybody involved gets to wear a set of pretty bracelets and a ride to county lock up "just in case". the judge will sort this shit out later. im temted to add an lol, but the shit just really aint funny. ahhh wtf lol.

basically, the guy growing is responsible, the guy who owns has plausible deniability of the action, but in all honesty, #2 and #3 are the most liable, frankly because #2 will blame #3 and the cops are really only looking to prosecute one guy, otherwise it's too much work. #2 could be charged as an accomplice but if he can prove he subleted to #3 then that's who is gonna be thrown to the dogs. In most of these cases they only want one person and as many people that point the finger at one guy that's the one they'll charge. #2 frankly would be a moron for renting the space and not watching what's going on. So basically either 2 or 3 is gonna be bent over for the growing. Basically renting and growing should only be conducted between 2 people, the rentor and the rentee that way you aren't putting other people's lives in the hands of people who are going to be doing something that is probably illegal.
