When the 5-0 seize your home for a grow, do they seize every single item in your home as well? Clothes, computer, etc.?

I can't be sure because it has never happened to me, but they take anything related to your grow uncluding lighting, nutes, any notes or pictures you may have, etc... but they have to be able to prove that it's related.

There is a thread floating around where the guy got his shit taken (but was legal) and they took all his lights and whatnot including ones that weren't even in use (I believe they were in the home but not in the grow room); Since he was legal and had nothing to fear he managed to get the lights that weren't in use back before he was able to get the rest of his stuff back (the stuff that was in use). I'd imagine that if you aren't legal it wont matter anyway, but in his case it seems they weren't supposed to take anything that wasn't in use.

Hope that helps, and maybe someone else has better info than me :)

like he said, they can.. like if you bought anything with drug money.. then they consider that to be related to the incident. It sucks, but its what they do.

But again, they also have to be able to prove that the items are related to the incident.

Hope you didn't have anything incriminating on your computer. :|

good luck my friend..

peace.

Cops would love to shoot those pups! They love live target practice, and since dog killing doesn't bring any stiff penalties, cops love to cap off a few. It ain't nothing to them.

If they sieze the home, you will have to move out and live somewhere else.

If they do a grow bust they will have a warrent with them and in the warrent it has to list what they are looking for and will sieze everything releated to growing. They would have to prove the dishwasher, etc etc etc was used to assist in the grow

For them to sieze the computer and turn it on they would have to have it listed on the warrent.

Thats why lawyers are paid big money, its for them to do their job and get things thrown out of court

At the initial raid they will take anything the see grow related, lights, bongs, weed, EVERY SCRAP OF PAPER!!!!!, possibly computers, any cash, possibly render the main power feed inoperable if they feel someone is going to get the bright idea to set up shop behind the police tape (yes it happens) they usually leave some weed behind..after all your going to need if you post bail and see what they have done.

As for seizing of assets, this should happen after you are sentenced and proven guilty. Most states dictate that they need proof that you have bought assets from drug money, however this is not always the case....take for example a car transporting drugs....the judge may see it as a TOOL used to commit the crime. As where the police impound the car for the time being until sentencing. Its is a stretch that your home will be treated in the same fashion. I think being assed out of a place to live will be the least of your concerns.

seizing of assets is funding for law enforcement toys and programs. They like to seize stuff....after all who doesn't like free $ to pay for stuff. mortgage paid off...you bet your ass they will fight tooth and nail for it. less hoops to jump through. If your home is worth 140,000 and the bank still owns a majority of the note they will probably look for bigger and better fish to fry. The county you live in really determines how bad they are going to come after you or if the even bother that much. The county I live in has a major hardon for seizing shit. There are some websites that have statistical data of $ and property seized by county. you can come to your own conclusion based on other data from arrests. Dig dig dig far into public records even have a sit down with a lawyer. The ideal situation would be to have as little ownership of the house as possible. Borrow against the house, and hide that money well. After all your paying interest.....but if your worried that much....remember money does grow on trees.............literally.:weed:

Now I know a friends father that got popped for a MAJOR meth manufacturing and distro that was found guilty. The property was paid for free and clear however the property was in such distress that the courts did not bother. This was in a southern state, in a very rural county...they basically looked and said we get more money from taxes. The friend and me went to rehab the home to rent out while the father was incarcerated...we waited till all legal preceding were done before we could get to work....we just let all the tweakers run a muck till everything was over....was fun...found a mobile meth lab. We chased alot of them away with bats and guns. Glad we had brought alot of muscle.

Laws are different everywhere so do your homework...it will pay off.

If they have probable cause to believe that something was bought with drug money they will take it! They will usually take things someone robbing your house would take... I've watched buddies lose their flat screen tv's, xbox's, any cash laying around.. things that would auction easily at a police auction... Drug seizing is guilty until proven innocent/legally paid for.
